Development Plan Review <br />Section 1126.09 Expiration and Extensions <br />A. Expiration. Building permits must be obtained within one (1) year of the date of final plan <br />approval or the approval expires, along with the approval of any related variances. Upon <br />expiration, no person shall acquire any vested property interest in or upon the land <br />whatsoever, nor otherwise acquire any vested right to proceed with construction based upon <br />such expired final development plan approval. Upon expiration, any variances from this <br />Code that may have been issued in support thereof shall likewise expire, shall not vest any <br />property right, and shall not run with the land. <br />B. Extensions. Upon request from the developer or approval holder, the Planning and <br />Development Director may grant one (1) extension of up to twelve (12) additional months <br />provided that: <br />1. The applicant provides the Planning and Development Department with a written request <br />for an extension prior to the date of expiration of the original development plan approval; <br />2. There are no changes in the project; and <br />3. The zoning of the property is the same as when the project was approved. <br />Section 1126.10 Compliance with Approved Plans <br />A. No site development, improvement or construction activities shall be commenced or <br />permitted that fail to comply with approved development plans, including all conditions <br />imposed or variances issued, except upon amendment authorized' and issued pursuant to <br />Section 1126.08. Any such deviation from final approved development plans shall be subject <br />to an immediate Stop Work Order and penalties provided by Chapter 1121. <br />I1 <br />For purposes of this section, "final approved development plan" means the finally approved <br />building, site and signage plans for the property, the 'landscaping and lighting plans for the <br />property, and all statements concerning the use and/or development of the property <br />appearing affirmatively on the face of the record of the proceedings of the owner's <br />application for a development pian which were expressly made a condition of Administrative <br />approval or City Council's approval pursuant to the provisions of Section 1126.05. <br />Page 1126-9 City of North Olmsted Zoning Code <br />
