WHEREAS, after careful consideration, the Planning and Design Commission of the City,
<br />on the 22nd day of February, 2017, by formal motion, recommended new and revised zoning code
<br />sections 1115, 1117, 1118, 1119, 1121, 1126, 1139, 1161, together with an Appendix A and a
<br />Revised Zoning Map, be approved; and
<br />WHEREAS, following publication of newspaper notice in conformance with the
<br />provisions of Section 14 of Article IV of the Charter and Section 1127.03 of the Zoning Code, a
<br />public hearing was held on the _ day of -, ` ; , 2017; and
<br />WHEREAS, it is the desire of this Council to amend the Zoning Code and adopt the Zoning
<br />Map, all as recommended by the Planning and Design Commission, in order to promote smart
<br />growth and to advance the objectives of the City of North Olmsted Master Plan.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF
<br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO:
<br />SECTION 1: That Chapters 1115 "Definitions," 1117 "Administration and Enforcement,"
<br />1118 "Conditional Use Permit," 1119 "Building Permit and Certificates of Occupancy," 1121
<br />"Penalties and Remedies," 1126 "Commercial and Other Building Permits," 1139 "Business
<br />Districts," 1161 "Offstreet Parking and Loading" of the City of North Olmsted Zoning Code
<br />Chapter 11, "Planning and Zoning Code," which presently read in their entirety as set forth in the
<br />document attached to this Ordinance as Exhibit A and incorporated herein by reference as if fully
<br />restated, be amended, and, as amended, shall read in their entirety as set forth in the document
<br />attached to this Ordinance as Exhibit B and incorporated herein by reference as if fully restated.
<br />SECTION 2: That the Appendix, "Tree and Plant List," which reads in its entirety as set
<br />forth in the document attached to this Ordinance as Exhibit C and incorporated herein by
<br />reference as if fully restated, is hereby adopted and made a new part of City of North Olmsted
<br />Zoning Code Chapter 11 titled "Planning and Zoning Code."
<br />SECTION 3: That the Zoning Map, as set forth in the document attached to this
<br />Ordinance as Exhibit D and incorporated herein by reference, is hereby adopted as the official
<br />Zoning Map for the City of North Olmsted.
<br />SECTION 4: That the Clerk of Council be and he is hereby directed to cause notice of a
<br />Public Hearing hereon to be given pursuant to the provisions of Section 14 of Article IV of the
<br />Charter of the City of North Olmsted and Section 1127.03 of the North Olmsted Zoning Code.
<br />SECTION 5: That, in all other respects, the North Olmsted Zoning Code, as amended
<br />and supplemented from time to time, shall remain in full force and effect.
