Z. <br />Ch. 1126 <br />1119.01 BUILDING PERMIT REQUIRED; REAL PROPERTY TAXES. <br />(a) No excavation for a foundation, nor the erection, construction or alteration of <br />any structure or part of a structure, nor occupancy of any street or alley with the building <br />materials, nor erection of temporary structures for construction purposes, nor any other <br />improvement to real property for which a building permit is required, shall be undertaken until <br />a building permit therefor has been issued by the Building Official. <br />(b) No building permit required by subsection (a) hereof for commercial <br />construction or new residential construction shall be issued unless the applicant first submits to <br />the Building Official a statement from the County Treasurer certifying either that all real <br />property taxes due and owing on the property for which the permit is sought have been paid, <br />or that the owner has entered into an agreement with the County Treasurer which will provide <br />for the payment of all real property taxes presently due and owing on the property. For <br />purposes of this paragraph only "commercial construction" shall mean the construction of any <br />building or building addition on land in the City which is zoned for any use other than single- <br />family, two-family or single family cluster, and "new residential construction" shall mean the <br />construction of any building or building addition on land which is zoned for single-family, two- <br />family or single family cluster use. <br />(Ord. 99-113. Passed 12-5-00.) <br />1119.02 CERTIFICATE OF OCCUPANCY REQUIRED. <br />No vacant land and no building hereafter erected or altered shall be occupied or used, <br />in whole or in part, nor shall any owner or tenant of any land or building hereafter change the <br />use classification or enlarge the use of any building or any premises, including offstreet <br />parking, without a certificate of occupancy issued by the Building Official stating that the use <br />of the building or premises complied with the provisions of this Zoning Code. <br />(a) Application with Building Permit Application. Each applicant for a building <br />permit shall file with the Building Official an application for a certificate of <br />occupancy of the building proposed to be constructed or altered prior to and as a <br />condition to the issuance of such building permit. No building permit shall be <br />issued if the structure planned or the use disclosed in the application for a <br />certificate of occupancy violates any provision of this Code. <br />December 2016 Replacement <br />
