1118.05 PLANNING AND ZONING CODE 36 <br />(5) Lighting. Flood lighting or other lighting of playfields, buildings, <br />bulletin boards and parking areas shall be located and designed so as to <br />shield the light source from adjoining residences, and, except for general <br />lighting, shall be extinguished between 11:00 p.m. and 7:00 a. m. of the <br />following day. <br />(b) Vehicle Repair Establishment. <br />(1) All vehicle maintenance or repairs shall be wholly conducted within an <br />enclosed structure. <br />(2) All automobile parts, dismantled vehicles, and similar materials shall be <br />stored within an enclosed building or totally screened from view by a <br />solid or privacy fence. A chain link fence with slats shall not constitute <br />acceptable screening or fencing for the purposes of this condition. <br />(Ord. 2006-162. Passed 1-2-07.) <br />1118.05 EXPIRATION. <br />The approval of a conditional use permit shall become null and void if the construction <br />of a building or related site improvements are not started within one (1) year following the date <br />of approval. (Ord. 2006-162. Passed 1-2-07.) <br />1118.06 REVOCATION. <br />(a) Duties of the Commissioner. Upon determination by the Building <br />Commissioner that there are reasonable grounds for revocation of a conditional use permit, a <br />revocation hearing shall be set before City Council. <br />(b) Notice and Public Hearing Notice shall be given in the same manner required <br />for a public hearing to consider approval. <br />(c) Hearing. City Council shall hear testimony of City staff and the owner of the <br />use or structure for which the permit was granted, if present. At a public hearing, the <br />testimony of any other interested person shall also be heard. <br />(d) Required Findings City Council shall revoke the permit upon making one or <br />more of the following findings: <br />(1) That the permit was issued on the basis of erroneous or misleading <br />information or misrepresentation; <br />(2) That the terms or conditions of approval of the permit have been violated <br />or that other laws or provisions have been violated; <br />(3) That there has been a discontinuance of the activity granted by the <br />conditional use permit for twelve consecutive months. <br />(e) Decision and Notice. Within ten (10) days of the conclusion of the hearing, <br />City Council shall render a decision and the Building Commissioner shall mail notice of the <br />decision to the owner of the use or structure for which the permit was issued and to any other <br />person who has filed a written request for such notice. <br />(f) Effective Date. A decision to revoke a conditional use permit shall become final <br />ten (10) days after the date of the decision. <br />(Ord. 2006-162. Passed 1-2-07.) <br />December 2016 Replacement <br />
