1126.05 PLANNING AND ZONING CODE 54 <br />1126.05 SUBMITTAL OF FINAL DEVELOPMENT PLAN. <br />(a) After the preparation of preliminary plans pursuant to Sections 1126.01 through <br />1126.04, sixteen complete sets of the final development plans shall be submitted to the <br />Building Department accompanied by any required application forms and nonrefundable <br />application fees as per the adopted schedule of fees. All applications and development plans <br />required by this chapter shall be reviewed by the Building Official and Director of Planning. <br />(b) In the event an application contains a proposal which is violative of the zoning <br />or another applicable code of the City, or the application is not accompanied by all drawings <br />and other documents or materials required by Section 1126.03 and 1126.04, or by rule of the <br />Building Official and, if applicable, by rule of the Planning and Design Commission, it shall be <br />rejected by the Building Official, who shall notify the applicant of the reasons for the rejection <br />within seven days of submittal. <br />(c) In the event an application contains a proposal which meets all requirements of <br />the zoning and all other applicable codes of the City and is accompanied by all drawings and <br />other documents and materials required by Section 1126.03 and 1126.04 and by the rules of <br />the Building Official, and, if applicable, by rule of the Planning and Design Commission, it <br />shall be referred to the Planning and Design Commission for its recommendations at its next <br />available regularly scheduled meeting. <br />(d) In the event that the application contains a proposal which requests a variance or <br />variances from the applicability of any provision of the Zoning Code of the City, but in all <br />other respects complies with the zoning and all other applicable codes of the City, and is <br />accompanied by all drawings and other documents and materials required by Section 1126.03 <br />and 1126.04 and by the rules of the Building Official, and, if applicable, by rule of the <br />Planning and Design Commission, it shall be referred to the Planning and Design Commission, <br />at its next available regularly scheduled meeting, for its recommendations on the variance <br />request prior to referral to the Building and Zoning Board of Appeals. <br />(e) The Building Official and the Director of Planning may request, in the interest <br />of expediting the review process and in anticipation of a Planning and Design Commission <br />requirement thereof, the comment or report of any appropriate City official or department and <br />shall, in the event that development proceeds under subsection (d), provide a report and <br />recommendation to the Planning and Design Commission and the Building and Zoning Board <br />of Appeals on the variances requested. <br />(Ord. 2004-153. Passed 8-2-16.) <br />1126.06 ADDITIONAL SUBMITTAL REQUIREMENTS. <br />(a) The applicant shall submit along with final development plans a current and <br />accurate legal description of the property or properties in question. <br />(b) The applicant is responsible for providing a list of names, mailing addresses and <br />parcel numbers of all property owners requiring notification as defined in Section 149.02 of the <br />Administrative Code.
