53 Commercial and Other Building Permits 1126.04 <br />1126.04 MASTER SIGN PLAN. <br />(a) Any commercial development application for property located in Limited <br />Industry Office District, Mixed Use, or General Retail Business District, which includes <br />multiple signs for multiple units of tenants, however described, shall submit and maintain a <br />Master Sign Plan as part of its approved development plans herein. The purpose of the Master <br />Sign Plan is to require to the extent practical, the owner or developer of such commercial <br />facilities to maintain consistency among the various units or tenants as to the height, width, <br />size, square footage, location, illumination and type of fixture for every sign planned for a <br />development and to thereby specifically plan for the equal allocation of area requirements <br />among existing, planned and future units or tenants in accordance with the Sign Code and all <br />other zoning restrictions. <br />(b) As used in this section and for all other review procedures including but not <br />limited to Chapters 1123, 1126 and 1163, the following definitions shall apply: <br />(1) "Master Sign Plan" shall mean a site plan or other rendering subject to <br />the same standards and requirements as other building and sign plans <br />submitted to and reviewed by the Building Commissioner pursuant to <br />Chapter 1126 and 1163, which identifies and described (without regard <br />to content) each and every sign planned for a development in terms of its <br />height, width, size, square footage, location, illumination and type of <br />fixture. The Master Sign Plan may be incorporated into other site plans <br />elevations or renderings submitted pursuant to Section 1126.02 or <br />Chapter 1163, so long as the Building Department can clearly identify <br />every sign planned for a development and determine its compliance. <br />(2) "Every sign planned for a development" shall mean every sign existing <br />or proposed to be installed immediately on any parcel of land proposed <br />for development including parcels adjoined by common ownership or <br />parking area and shall also include all signs that may be proposed in the <br />future for phased or multiple tenant facilities. <br />(c) No Master Sign Plan shall be approved unless every sign planned for a <br />development complies with the requirements imposed by Chapter 1163, as well as any other <br />applicable zoning restrictions, with the exception of the owner's right to maintain pre-existing <br />and nonconforming signs, and with the exception of any sign variances previously granted by <br />the Building and Zoning Board of Appeals. In cases where a Master Sign Plan is required, no <br />commercial building permits shall be issued pursuant to Chapter 1126, except as otherwise <br />provided by Section 1163.06(e), until a Master Sign Plan has been approved in conjunction <br />therewith or, upon Council's disapproval of the Master Sign Plan, a variance has been granted <br />by the Building and Zoning Board of Appeals. <br />(d) Following the adoption of a Master Sign Plan, every sign permit issued for the <br />site pursuant to Chapter 1163 must conform therewith, unless the approved Master Sign Plan is <br />thereafter modified or amended and, if applicable, a variance is granted by the Building and <br />Zoning Board of Appeals. No modification or amendment of a Master Sign Plan shall be <br />granted by Council until the request has been reviewed by the Planning and Design <br />Commission. Before granting a variance for any sign subject to a Master Sign Plan, the <br />Building and Zoning Board of Appeals shall take into consideration the existing Master Sign <br />Plan, whether or not amendments thereto have been approved or denied by Council, and <br />whether or not the applicant's proposal deviates from the landowner's Master Sign Plan. <br />(Ord. 2004-153.
