93 Business Districts 1139.04 <br />1139.03 OUTDOOR TELEPHONE PAY STATIONS. <br />The following shall constitute the regulations, procedures and guidelines for the <br />installation of outdoor telephone pay stations within the City. <br />(a) No freestanding telephone structure, nor any telephone structure which is <br />attached to a building exterior, shall be installed until such time as the <br />applicant has filed the proper application for a building permit, and the same <br />has been granted. Such application shall contain a signed document from the <br />property owner granting the applicant permission to have such telephone <br />structure installed. <br />(b) Prior to a permit being issued, the Building Official, or his designated <br />representative, shall: <br />(1) Determine that the proposed structure does not impede the flow of <br />vehicular nor pedestrian traffic; <br />(2) Determine that the proposed structure does not present any hazardous <br />situation; <br />(3) Determine that the proposed structure does not, in any way, infringe <br />upon the rights of adjacent residents or property owners; and <br />(4) Present the proposal to the Building, Zoning and Development <br />Committee of Council, and obtain the approval of the Committee. <br />(c) The telephone company supplying the service shall be responsible for the <br />proper maintenance of the structure and maintaining the equipment in working <br />condition. The applicant shall keep the area free of litter and debris. <br />(d) For purposes of granting or denying the required permit, the following <br />guidelines shall be observed. <br />(1) Where possible, any freestanding structure shall be at least five feet <br />from the side yard of any lot. <br />(2) The structure's location shall provide the user with easy access and <br />safety. <br />(3) The structure shall not obstruct any existing sign. <br />(4) Illumination shall be adequate, but in no case pose an inconvenience to <br />adjacent residences or businesses. <br />(5) Adequate parking shall be provided. <br />(6) The number and location of existing outdoor telephone pay stations in <br />the general area shall be considered. <br />(7) All service to an outdoor telephone pay station shall be installed <br />underground. <br />(8) Appropriate landscaping shall be provided. <br />(e) Decisions of the Building Official, his designated representative and/or the <br />Building, Zoning and Development Committee may be appealed to the <br />Council. The majority decision of Council shall be final. <br />(f) The company installing the equipment and supplying the telephone service <br />shall be registered with the Building Department, such registration to be <br />renewed annually. Passed 5-21-91.) <br />1139.04 HEIGHT LIMITATION. <br />The maximum height of buildings in Business Districts shall be in accordance with the <br />following: <br />District Stories <br />General Retail Business 5 <br />3 when adjacent to any One and <br />Two Family Residence and <br />Single Family Cluster District <br />Motorist Service 5 <br />(Ord. 90-125.
