93 Business Districts 1139.04 1139.03 OUTDOOR TELEPHONE PAY STATIONS. The following shall constitute the regulations, procedures and guidelines for the installation of outdoor telephone pay stations within the City. (a) No freestanding telephone structure, nor any telephone structure which is attached to a building exterior, shall be installed until such time as the applicant has filed the proper application for a building permit, and the same has been granted. Such application shall contain a signed document from the property owner granting the applicant permission to have such telephone structure installed. (b) Prior to a permit being issued, the Building Official, or his designated representative, shall: (1) Determine that the proposed structure does not impede the flow of vehicular nor pedestrian traffic; (2) Determine that the proposed structure does not present any hazardous situation; (3) Determine that the proposed structure does not, in any way, infringe upon the rights of adjacent residents or property owners; and (4) Present the proposal to the Building, Zoning and Development Committee of Council, and obtain the approval of the Committee. (c) The telephone company supplying the service shall be responsible for the proper maintenance of the structure and maintaining the equipment in working condition. The applicant shall keep the area free of litter and debris. (d) For purposes of granting or denying the required permit, the following guidelines shall be observed. (1) Where possible, any freestanding structure shall be at least five feet from the side yard of any lot. (2) The structure's location shall provide the user with easy access and safety. (3) The structure shall not obstruct any existing sign. (4) Illumination shall be adequate, but in no case pose an inconvenience to adjacent residences or businesses. (5) Adequate parking shall be provided. (6) The number and location of existing outdoor telephone pay stations in the general area shall be considered. (7) All service to an outdoor telephone pay station shall be installed underground. (8) Appropriate landscaping shall be provided. (e) Decisions of the Building Official, his designated representative and/or the Building, Zoning and Development Committee may be appealed to the Council. The majority decision of Council shall be final. (f) The company installing the equipment and supplying the telephone service shall be registered with the Building Department, such registration to be renewed annually. (Ord. 90-125.
