1139.08 PLANNING AND ZONING CODE 96 <br />1139.08 SUPPLEMENTARY YARD REGULATIONS. <br />(a) Setback on Corner Lots. For a corner lot in a Business District, the minimum <br />depth of a yard along either frontage shall be the depth of the yard which is required along the <br />same street for the adjoining lot. Offstreet parking shall be set back a minimum of twenty feet <br />from the side street right-of-way line on a corner lot. <br />(b) Variable Setback. Where any lot, including a corner lot, is of such <br />configuration, by virtue of its dimensions that it is practicable to require all offstreet parking to <br />be located behind the building, the Planning Commission may authorize or require that a <br />setback be established of no less than fifty feet from the street or streets upon which the lot <br />fronts. In such case, the setback area required or authorized shall be entirely landscaped, <br />except for required access to the lot, and no business activity including, but not limited to, <br />parking shall be permitted within the setback area. <br />(c) Side Yard Regulations for Business Buildings. In a General Retail Business <br />District, buildings shall meet the side yard requirements of Section 1139.06. However, if a <br />business building is located adjacent to another business building having a party wall and <br />common roof, no side yard between adjacent buildings shall be required. <br />(d) Canopies. Canopies covering gasoline pump islands providing protection from <br />inclement weather may be permitted in front of the established building line, provided that no <br />portion of such canopies is less than fifteen feet from any street right-of-way line and that the <br />design, height and location of the canopy is approved by the Planning and Design Commission. <br />(e) Offstreet Parkin A' reas. <br />(1) When an offstreet parking area is planned and designed as a <br />coordinated facility with adjacent existing or planned parking areas, the <br />Planning and Design Commission may waive the side yard parking or <br />drive setback requirement of this section. <br />(2) All accessory parking and service areas shall be defined by continuous <br />poured concrete curbing. <br />(3) Every required yard in which no offstreet parking or loading spaces are <br />permitted and any additional open areas shall be developed as lawn or <br />planted areas and maintained in an orderly state. <br />(4) The Commission shall require from each applicant for its approval, a <br />plan depicting the design of earth mounding, a fence, wall, hedge or <br />other suitable screening or planting in order to create a visual buffer <br />area where a residential district adjoins or abuts a rear or side yard of a <br />Business District. <br />(5) Sources of light for illumination of the exterior of buildings or grounds <br />shall be shielded so as not to create glare which would be objectionable <br />to users of adjacent property. <br />December 2016 Replacement <br />
