21 Definitions 1115.02 <br />(61) "Person" means a person or persons, firm or corporation. <br />(62) "Public utility" means any person, firm, corporation, governmental agency or <br />board fully authorized to furnish and furnishing under governmental regulation, <br />to the public, electricity, gas, steam, telephone, telegraph, transportation or <br />water, or any other similar public utilities. <br />(63) "Recreation (active)" means recreational activities that require physical <br />participation. Sports (such as baseball, tennis and golf) are typical of active <br />recreation. <br />(64) "Recreation (passive)" means pleasurable activities that involve relative inactivity, <br />such as sitting, strolling, card playing and picnics. <br />(65) "Regulation" means a rule, restriction or other mandatory provision in this Code <br />intended to control, require or prohibit an act. <br />(66) "Restaurant - Full Service" means a business establishment whose principal <br />business is the selling of unpackaged food to the customer in a ready -to -consume <br />state, in individual servings, or in non -disposable containers, and where the <br />customer consumes these foods while seated at tables or counters located within <br />the building. <br />(67) "Restaurant - Fast Food" means a business establishment that offers quick food <br />service, which is accomplished through a limited menu of items already prepared, <br />and held for service, or prepared, fried, or griddled quickly, or heated in a device <br />such as a microwave oven. Orders are generally not taken at the customer's <br />table, and the food is generally served in disposable wrapping or containers. <br />(68) "Restaurant - Limited Service" means a Fast -Food Restaurant that does not fry, <br />broil or griddle any of its menu items on site, whose gross floor area does not <br />exceed 2500 square feet, and that does not have a drive-thru facility. <br />(69) [Reserved] <br />(70) "Roadside stand" means a movable structure used or intended to be used solely <br />by the owner or the tenant of property on which it is located for the sale of <br />seasonal agricultural products produced on the premises which shall be removed <br />at the conclusion of the seasonal sales. <br />(71) "Secretary" means the duly acting secretary of the Planning and Design <br />Commission and Building and Zoning Board of Appeals. <br />(72) "Setback" means the required distance between the front of a structure and the <br />front lot line or the required distance between the structure and each of the <br />surrounding lot lines. <br />(73) "Setback (front)" means the minimum distance from the street line or front <br />property line to the building line measured along a line perpendicular to the street <br />line or front property line, or in the case of an arc street, measured perpendicular <br />to the chord of the arc describing the front property line at its midpoint and <br />measured from the chord line or from the radius of the arc itself, whichever is <br />greater. In the event one or more lots, or parcels of land, which are adjoining, <br />are used for the same use, or accessory uses, the setback line shall extend and be <br />the same for all lots or parcels so used. <br />December 2016 Replacement <br />
