1135.07 PLANNING AND ZONING CODE 66 <br />(b) Corner Lots. For a corner lot in any One and Two Family Residence District, <br />the minimum setback on the street the house fronts upon shall be fifty feet, and the minimum <br />setback on the street upon which the side of the house faces shall be twenty-five feet, provided <br />that nothing in this provision shall be so interpreted as to reduce the buildable width of a corner <br />lot of record at the Cuyahoga County Recorder's Office at the time of the passage of the Zoning <br />Code to less than twenty-five feet or to require the most restrictive of the two setbacks to exceed <br />twenty-five feet. No part of a detached garage shall be closer to either street than the minimum <br />setback as established by this subsection along the same street from which such garage is <br />entered. (Ord. 90-125. Passed 5-21-91.) <br />1135.07 SIDE YARD REQUIREMENTS. <br />(a) Minimum Widths. In One and Two Family Residence Districts, the minimum <br />width of the side yard shall be, on one side, not less than five feet and the sum of the two sides <br />shall be not less than twenty feet, unless the dwelling is designed to have an attached garage, in <br />which case the sum of the two sides shall not be less than fifteen feet. In no case shall the <br />distance between adjacent dwellings be less than fifteen feet. <br />A drive may be placed in a side yard providing such side yard is no less than fifteen feet <br />in width. <br />(b) Computation of Widths. In computing the minimum side yard requirements, the <br />following rules shall prevail: <br />(1) The width of a side yard shall bA determined at the point of the least <br />distance from any part of the dwelling to the adjacent side line of the lot <br />measured at right angles to the side line. <br />(2) A cornice projecting not more than twenty-four inches or a fence shall not <br />reduce the required minimum distance. <br />(Ord. 90-125. Passed 5-21-91.) <br />1135.08 REAR YARD REQUIREMENTS. <br />(a) Minimum Depths. In One and Two Family Residence Districts, the minimum <br />depth of the rear yard shall be fifty feet. <br />(b) Computation of Depths. In computing the minimum rear yard requirements, <br />the following rules shall prevail: <br />(1) The depth required shall be determined exclusive of any portion used for <br />accessory structures. <br />(2) In case the rear lot line is not parallel with the street line, the average <br />depth shall be used. <br />(3) On a through lot, the setback requirements set forth in Section 1135.06 <br />shall prevail and not the rear yard requirements of this section. <br />(4) A cornice projecting not more than twenty-four inches or a fence shall <br />not reduce the required minimum distance. <br />(5) Where a stairwell for access to below grade portions of a dwelling has <br />been legally constructed prior to the adoption of this Code, the <br />installation of an enclosure or covering of this stairwell shall be <br />excluded when computing rear yard depths. <br />(Ord. 91-88. Passed 10-1-91.) <br />1135.09 ARCHITECTURAL APPURTENANCES. <br />Architectural appurtenances which do not increase the livable floor area of a dwelling <br />unit may project not more than twenty-four inches into a required yard area.
