1. Restrictions Concerning LPA Preferences <br />The LPA shall not offer direction to consultants concerning preferences (or informal sanctions) <br />for certain subconsultants or team arrangements. These arrangements are business decisions <br />that must be made by consultants without direction from the LPA. The LPA must make <br />selection decisions on the basis of proposed teams without advance "steering" of teams. <br />2. Communications Restrictions <br />Please note the following policy concerning communication between Consultants and the LPA <br />during the announcement and selection process: <br />During the time period between advertisement and the announcement of final consultant <br />selections for the Programmatic Selection Process, communication with consultants (or their <br />agents) shall be limited as follows: <br />a. Communications which are strictly prohibited: <br />(1) Communication with the LPA: Any marketing or similar discussions of the specific <br />project if the consultant has submitted or plans to submit a letter of interest, or is <br />included as a subconsultant on a submittal by another firm. <br />b. Allowable communications include: <br />(1) Project administration activities for authorized agreements, scope and <br />negotiation activities for projects selected but not under contract. <br />(2) Technical or scope of services questions specific to projects posted with a <br />programmatic group. <br />c. When completed selections must be publicly announced. <br />3. Advertisement <br />For selection procedures that require public notification, Requests for Letters of Interest "RFLol" <br />must be advertised on the Consultant Services page of ODOT's website. <br />4. Disclosure of Selection Information <br />All selection information including consultant letters of interest shall be available for public <br />disclosure upon completion of the selection. <br />Information that is not subject to public disclosure at any time includes financial statements <br />and other confidential financial information submitted by a consultant. <br />5. Supporting Documentation <br />Documentation supporting the solicitation, proposal, evaluation, and selection of the <br />consultant shall be retained. <br />6.
