Title 40 United States Code, Subtitle I, Chapter 11, Sections 1101-1104, commonly called the "Brooks <br />Act." — "Selection of Architects and Engineers" <br />O. 48 CFR Part 31— Federal Acquisition Regulations <br />P. 23 CFR 636.116 - Organizational Conflict of Interest Requirements for Design -Build Projects <br />Q. 23 CFR 645 - Utilities <br />R. 49 CFR PART 26 - Participation by Disadvantaged Business Enterprises "DBE" in Department of <br />Transportation Financial Assistance Programs <br />2.2 The LPA shall comply with all applicable Federal and State laws, regulations, executive orders, and <br />applicable ODOT manuals and guidelines. This obligation is in addition to compliance with any law, <br />regulation, or executive order specifically referenced in this Agreement. <br />3. FUNDING <br />3.1 The total cost for the PROJECT is estimated to be $4,056,000.00 as set forth in Attachment 1. ODOT shall <br />provide to the LPA 50 percent of the eligible costs for right of way acquisition cost, up to a maximum of <br />$25,000.00 in Federal MPO-CMAQ funds (4BT7); 80 percent of the eligible construction costs, up to a <br />maximum of $3,204,800.00 in Federal MPO-CMAQ funds (4BT7). These maximum amounts reflect the <br />funding limits for the PROJECT set by the applicable Program Managers, and costs beyond the stated <br />maximums will be the responsibility of the LPA. Unless otherwise provided, funds through ODOT shall be <br />applied only to the eligible costs associated with the actual construction of the transportation project <br />improvements and construction engineering/inspection activities. <br />3.2 The LPA shall provide all other financial resources necessary to fully complete the PROJECT, including all <br />100 percent Locally -funded work, cost overruns and contractor claims. <br />4. PROJECT DEVELOPMENT <br />4.1 The LPA and ODOT agree that the LPA has received funding approval for the PROJECT from the applicable <br />ODOT Program Manager having responsibility for monitoring such projects using the Federal funds <br />involved. <br />4.2 Project Development shall follow ODOT's Project Development Process and all ODOT standards for <br />environmental evaluations, design, plan preparation, right of way acquisition, utility relocation and other <br />processes as set out in the Department's Design Reference Resource Center, available on ODOT's website <br />(www.dot.state.oh.us/drrc/Pages/def ault.aspx).
