MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />SEPTEMBER 5, 2017 <br />Present: Council President Jones, Council Members Brossard, Hemann, Kearney, <br />Limpert, Rahm, Schumann & Williamson <br />Also Present: Mayor Kennedy, Director of Finance Copfer, Director of Human <br />Resources Gallo, Director of Safety & Service Glauner, Director of Law <br />Gareau and Clerk of Council Massarolo <br />Absent: Director of Planning & Development Lieber <br />Council President Jones called the meeting to order at 8:00 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />The Council meeting minutes of August 15, 2017 were approved as written. <br />The following legislation will be considered for passage under suspension of the rules <br />this evening: Second Reading — Resolution 2017-57 and Ordinance 2017-58. <br />REPORTS <br />Mayor Kennedy: <br />• The September 11 ceremony will be held at Fire Station number 1 at 9:45 a.m. <br />until 10:15 a.m. <br />• The Mayor swore in Steve Dombek to Sergeant for the North Olmsted Police <br />Department. The oath is attached to the minutes. <br />Director of Law Gareau: <br />• The last time there was a major flooding event in North Olmsted in addition to <br />residential losses there was a significant issue of damage and loss to the <br />Wastewater Treatment Plant and some upgrades taking place there at the time of <br />the flooding. We have had issues with the contractors and who was going to pay <br />for it. For the past three years, the City has said no we are not going to pay for it <br />as we did nothing wrong. The City is hopefully getting close to a resolution in this <br />issue with the contractors and my hope is the City will not end up paying for it. <br />We are still owing on some of the contract money. They just want to get the rest <br />of their money due under the contract and go on their way. <br />• In the matter of Theresa Sullivan v. Regina Opheim. This was a lawsuit filed <br />against the City and its prosecutor. It was filed exclusively based on his duties as <br />a prosecutor. There are at least three sections in the common law which state why <br />he is immune from litigation. There has been a motion filed and a hearing <br />scheduled for tomorrow where the City can hopefully also get this behind it as <br />well. <br />
