(b) In the event of no such notification to the City, the City shall be limited to <br />recovery of delinquent sewer user charges to a maximum of five years prior to discovery <br />by the City of said non -billing and any sewer user charges occurring between discovery <br />and commencement of the sewer billing period by the Cleveland Water Department for <br />the property served. Discovery shall be a written finding by the Service Director <br />following an investigation into the situation to determine if a property is being served by <br />the municipal sanitary sewerage system without being billed for the quarterly sewer user <br />charges. <br />(c) Recovery shall be based upon the current rate per 1,000 cubic feet times a <br />minimum of 1,000 cubic feet of water per quarter. Where the property served would <br />be expected to consume more than 1,000 cubic feet of water per quarter, the Service <br />Director shall, on the basis of accepted engineering practices, determine the quantity of <br />water to be used in calculating the delinquent charges for recovery. <br />(d) Where a property has been illegally tapped -in to the municipal sanitary <br />sewerage system, the owner or agent of said property shall obtain and pay for a tap - <br />in permit. A late charge shall be added to the regular tap -in fee in an amount of ten <br />percent (10%) of the regular fee. <br />(e) Remedy for non-payment shall be as per Sections 915.15, 915.16, and <br />915.17 or other methods allowed by law. <br />(Ord. 99-66. Passed 9-21-99.) <br />915.20 PAYMENT REGULATIONS; HARDSHIP <br />CONSIDERATION. <br />(a) The following payment regulations shall apply for unbilled sanitary sewer <br />charges owed by users pursuant to Section 915.19 as follows: <br />(1) For amounts due less than or equal to three hundred dollars ($300.00), <br />users shall be required to make a single payment to the Director of Finance in the <br />full amount due; <br />(2) For amounts due in excess of three hundred dollars ($300.00), <br />
