(a) Devices for measuring the volume of waste discharged may be required by the <br />Service Director if these volumes cannot otherwise be determined from the metered <br />water consumption records. <br />(b) Metering devices for determining the volume of waste shall be installed, owned <br />and maintained by the person. Following approval and installation, such meters may not <br />be removed without the consent of the Service Director. (Ord. 84-91. Passed 10-16-84.) <br />915.12 SURCHARGE RATES; REVIEW AND REVISION. <br />The unit rates of surcharge pursuant to Section 915.11 (d) or (e) shall be reviewed <br />annually by the Finance Director and Service Director and shall be amended from time to <br />time by Council upon the recommendation of the Service Director applying the formulae <br />set forth in Section 915.11. The purpose of the rate review shall be to determine whether <br />or not the rates are sufficient to defray the wastewater treatment plant OM&R costs as <br />determined from the wastewater treatment plant records. If the difference between the <br />revenue derived from the rates of surcharge and the total annual cost is sufficient to <br />justify an increase or decrease in the rates, the Service Director shall make the <br />appropriate recommendation to Council requesting the rates be amended. <br />(Ord. 84-91. Passed 10-16-84.) <br />915.19 NON -BILLED SEWER USER CHARGES. <br />The provisions of this section shall apply to users of the municipal sanitary sewerage <br />system and which are in that portion of the system for which sewer user charges paid to <br />the City are based on water consumption as per Section 915.07. <br />(a) Any user of the municipal sanitary sewerage system for which the property <br />served was legally or illegally tapped -in to the system and which sewer user charges <br />have not been billed by the Cleveland Water Department may notify the City <br />Engineer in writing of said non -billing. In the event of such notification, the City <br />shall be limited to recovery of delinquent sewer user charges to a maximum of one <br />year prior to said notification and any sewer user charges occurring between <br />notification to the City and commencement of the sewer billing period by the <br />Cleveland Water Department for the property served. <br />
