ARTICLE 1 PURPOSE <br />1.01 This Agreement is made between the City of North Olmsted, hereinafter referred to as the <br />"Employer", and Ohio Council 8 and Local No. 2681 of the American Federation of State, <br />County and Municipal Employees, AFL-CIO, hereinafter referred to as the "Union". The <br />purpose of this Agreement is to provide a fair and responsible method of enabling employees <br />covered by the Contract to participate through Union representation in the establishment of terms <br />and conditions and of their employment, including rates of pay, wages, hours and working <br />conditions, and to establish a peaceful procedure for the resolution of all differences between the <br />parties. <br />ARTICLE 2 RECOGNITION <br />2.01 The Union is recognized as the sole and exclusive representative for a bargaining unit of <br />all clerical and technical employees of the City of North Olmsted in the classifications contained <br />in Article 28, with respect to wages, hours and other terms and conditions of employment, <br />excluding all confidential, management and supervisory employees as defined in O.R.C. 4117 <br />and all other employees of the Employer. <br />ARTICLE 3 NON-DISCRIMINATION <br />3.01 Both the Employer and the Union recognize their respective responsibilities under the <br />federal and state civil rights law, fair employment practice acts and other similar constitutional <br />and statutory requirements. Therefore, both, the Employer and the Union hereby reaffirm their <br />commitments, legal and moral, not to discriminate in any manner relating to employment on the <br />basis of race, color, religion, national origin, sex, age, or disability. <br />3.02 The Employer recognizes the right of all employees and all applicants for employment to <br />be free to join the Union and participate in lawful, concerted union activities. Therefore, the <br />Employer agrees that there shall be no discrimination, interference, restraint, coercion, or reprisal <br />by the Employer against any employee because of union membership or because of any lawful <br />activity in an official capacity on behalf of the Union. The Union recognizes the right of all <br />employees and all applicants for employment to be free to join or not to join the Union. <br />3.03 All of the employees of the Employer within the bargaining unit shall receive equitable <br />treatment and share in any and all benefits provided herein. <br />ARTICLE 4 CHECK-OFF/FAIR SHARE FEE <br />4.01 The Employer shall deduct the initiation fee and regular monthly dues from the pay of <br />employees covered by this Agreement upon receipt from the Union of individual written <br />authorization cards voluntarily executed by an employee for that purpose and bearing his <br />signature, provided that any employee shall have the right to revoke such authorization. <br />4.02 Deductions under this Article 4 shall be made during the second pay period of each <br />month, but if an employee's pay for that period is insufficient to cover Union dues, the Employer <br />
