Ordinance 2018-72: Exhibit B <br />application required by Section 1319.04 or, if no application has been filed, by the Cuyahoga <br />County tax duplicate records. <br />(b) Notwithstanding the requirement of notice provided herein, when in the opinion <br />of the Building Commissioner the condition of the structure or premises, or a part thereof, <br />constitutes an immediate hazard to human life or health, or when a prior violation notice has <br />been sent to the owner or agent for the same or similar violation, then no such notice of violation <br />need be given to the owner or agent of the structure containing a rental unit. <br />1319.08 APPEALS. <br />In case the Building Commissioner refuses to issue a license or cancels or suspends a <br />license, the applicant may appeal from such order to the Building and Zoning Board of Appeals. <br />The procedure for such appeal shall be consistent with Chapter 1315 of the North Olmsted <br />Codified Ordinances. <br />1319.09 MAINTENANCE REQUIREMENTS. <br />All structures and premises containing rental units and all parts thereof, both exterior and <br />interior, shall be maintained by the owner or owner's agent in good repair and shall be capable of <br />performing the function for which such structures or part of any feature thereof was designed or <br />intended to be used. Standards for exterior and interior maintenance are described in Chapters <br />1363 and 1364, respectively. <br />1319.10 TRANSIENT RENTAL REGULATIONS. <br />No owner of a dwelling unit shall permit the dwelling unit to be rented to, or occupied <br />by, transient renters, except as set forth in this Section. <br />(a) Renter Occupied Dwelling_ Units: No owner of a dwelling unit licensed as a rental <br />unit hereunder shall permit the rental unit to be rented to, or occupied by, transient renters. <br />(b) Owner Occupied Dwelling Units: The owner of a dwelling unit may have <br />transient rentals, provided as follows: <br />(1) The total number of calendar days, or parts of calendar days, that a <br />transient renter occupies a dwelling unit does not exceed fourteen (14) <br />days total in any calendar year; <br />(2) The owner of the dwelling unit uses the dwelling unit as his primary <br />residence when not rented to a transient renter; <br />(3) The owner of a dwelling unit or rental unit shall not permit single room <br />rentals to transient renters. "Single room rentals" as used herein is an <br />arrangement where multiple, unrelated renters, under separate rental <br />agreements, have exclusive possession of an individual sleeping facility <br />and shared access with other renters to all other facilities within a dwelling <br />unit. "Unrelated" as used herein is unrelated by blood or marriage. This <br />prohibition shall not apply in the event that the owner of the dwelling unit <br />is concurrently occupying the dwelling unit with the renter. This provision <br />is further subjected to the regulations contained in Chapter 1135 of the <br />Zoning Code. <br />1319.11 CONFLICT. <br />In the event of conflict between any provisions of this chapter, including any rules and <br />regulations adopted pursuant to this chapter, and any provisions of the ordinances of the City, <br />including any rules and regulations adopted pursuant to such ordinances, the more restrictive <br />provisions shall prevail. <br />1319.99 PENALTY. <br />(a) Any person, firm or corporation or agent thereof who violates any provision of <br />this chapter is guilty of a misdemeanor of the fourth degree for the first offense.
