Ordinance 2018-72: Exhibit A <br />1319.05 INSPECTIONS. <br />The Building Commissioner or his agent, is hereby authorized to make, or cause to be <br />made, inspections of all structures or premises containing rental units to determine whether such <br />structures or premises comply with City Ordinances, the Fire Prevention Code, or State laws. <br />The Commissioner shall notify the owner of any rental unit that is to be inspected, or his agent, <br />that arrangements must be made with the Building Commissioner for an inspection appointment <br />within ten (10) days of such notice. The owner or agent, upon consent, shall cause the entire <br />structure to be accessible for inspection at the time arranged, which shall be during regular <br />business hours. If the owner or agent, or an occupant, refuses to consent to an inspection of the <br />subject property, or if consent is otherwise unobtainable, the Commissioner or his or her agent <br />shall not make such inspection without first obtaining a search warrant. No license shall be <br />issued or renewed if any violation of City Ordinances, the Fire Prevention Code or State law <br />exists. <br />1319.06 SUSPENSION OF LICENSE. <br />The Building Commissioner may suspend the license required in Section 1319.03, upon <br />finding or being advised by the Fire Chief or Police Chief that such premises are in violation of <br />any provision of this chapter or any other ordinance or resolution of the City. <br />1319.07 CANCELLATION OF LICENSE; NOTIFICATION. <br />The Building Commissioner may cancel any license issued hereunder and withdraw a <br />certificate of occupancy for any rental unit when a violation of a State law, the Fire Prevention <br />Code, or City ordinance has been found to exist on the premises in excess of thirty days after <br />notice has been sent to the owner of such rental unit. Notification for the purpose of this section <br />shall be by certified or registered mail to the owner at the address shown on the Application <br />required by Section 1319.04 or, if no application has been filed, by the Cuyahoga County tax <br />duplicate records. <br />Notwithstanding the requirement of notice provided herein, when in the opinion of the <br />Building Commissioner the condition of the structure or premises, or a part thereof, constitutes <br />an immediate hazard to human life or health, or when a prior violation notice has been sent to the <br />owner or agent for the same or similar violation, then no such notice of violation need be given <br />to the owner or agent of the structure containing a rental unit. <br />1319.08 APPEALS. <br />In case the Building Commissioner refuses to issue a license or cancels or suspends a <br />license, the applicant may appeal from such order to the Building and Zoning Board of Appeals. <br />The procedure for such appeal shall be consistent with Chapter 1315 of the North Olmsted <br />Codified Ordinances. <br />1319.09 DUTIES OF MANAGEMENT. <br />(a) The license issued by the City and required by Section 1319.03 shall be <br />conspicuously displayed in every structure containing a rental unit. <br />(b) Each rental unit shall be under the direct management of the owner or his agent or <br />representative. It shall be their duty to maintain a record which shall include the names of all <br />persons being accommodated. <br />(c) It shall be the duty of the owner to take such other measures as may be deemed <br />necessary by the Building Commissioner to preserve the health, comfort and safety of all persons <br />
