MINUTES OF THE SPECIAL MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />AUGUST 7, 2018 <br />Present: Council President Jones, Council Members Brossard, Glassburn, Hemann, <br />Kearney, Limpert, Schumann & Williamson <br />Also Present: Mayor Kennedy, Director of Human Resources Gallo, Director of Law <br />Gareau, Director of Safety & Service Glauner, Director of Planning & <br />Development Lieber and Clerk of Council Massarolo <br />Council President Jones called the meeting to order at 8:00 p.m. in Council Chambers, <br />5200 Dover Center Road, North Olmsted, Ohio. <br />Members of the audience were invited to join Council in the recitation of the Pledge of <br />Allegiance. <br />The Special Council meeting minutes of July 31, 2018 were approved as written. <br />No legislation will be considered under suspension of the rules this evening. <br />REPORTS <br />Mayor Kennedy: <br />• Homecoming is August 23 through 26 at North Olmsted Park. <br />• This year the Mayor's Race and the Homecoming Race are being combined into <br />the Fat Head's Race. In the past, both races would each have about 125 people. <br />Right now we have over 300 people signed up. It should be a lot of fun. It's going <br />to be around City Hall and up to Fat Head's. <br />Director of Law Gareau: <br />• In State ex rel. James Connell et al. v. City of North Olmsted et al., the flooding <br />class action from 2014 and earlier, the City is continuing mediation. There are <br />positive movements from both the Plaintiff's Counsel and our Insurance Defense <br />Counsel. This is an insured claim, so it is up to the insurance carrier to call the <br />shots on seeking resolution, if there is going to be one. There has been good <br />dialogue, I'm optimistic the case will come to a conclusion soon, but we will have <br />to see. <br />• Zayed v. Ventura, an excessive use of force claim against our police officers has <br />been settled and dismissed. <br />• The City of North Olmsted v. Christopher Fox. In this case, former Officer Fox <br />filed an unemployment claim. I reported a while ago the City did not prevail at the <br />Unemployment Hearing, which is not surprising as the employer almost never <br />prevails at this hearing. Upon review the Court of Common Pleas affirmed it. I <br />said before if the City did not prevail the City would go to the Court of Appeals <br />which is where we are now. <br />• Kate Montgomery has been hired as our new Law Clerk. She will be assisting the <br />Law Department, she will be overlapping with Kaitlyn Kilbane. <br />
