public hearing was held on the i�' day of2018; and <br />WHEREAS, it is the desire of this Council to amend Planning and Zoning Code Chapter <br />1135 as recommended by the Planning and Design Commission, in order to (l) establish Bed and <br />Breakfast Inns as conditional uses; (2) modify regulations concerning parking and driveways; and <br />(3) permit Book Exchange Boxes as accessory uses as set forth in the Ordinance. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Chapter 1135 which presently reads in its entirety as set forth in the <br />document attached to this Ordinance as Exhibit A and incorporated herein by reference as if fully <br />restated, be amended, and, as amended, shall read in its entirety as set forth in the document <br />attached to this Ordinance as Exhibit B and incorporated herein by reference as if fully restated. <br />SECTION 2: That the Clerk of Council be and he is hereby directed to cause notice of a <br />Public Hearing hereon to be given pursuant to the provisions of Section 14 of Article IV of the <br />Charter of the City of North Olmsted and Section 1127.03 of the North Olmsted Zoning Code. <br />SECTION 3: That, in all other respects, the North Olmsted Zoning Code, as amended <br />and supplemented from time to time, shall remain in full force and effect. <br />SECTION 4: That all other ordinances or parts of ordinances or resolutions that are <br />inconsistent or in conflict with the newly amended and adopted sections are likewise repealed to <br />the extent of such inconsistency or conflict only. <br />SECTION 5: That, if any section, paragraph, sentence, clause, phrase, term, provision or <br />part of this Ordinance, together with its Exhibit attached thereto, shall be adjudged by any court <br />of competent jurisdiction to be invalid or inoperative, such judgment shall not affect, impair or <br />invalidate the remainder thereof, but shall be confined in its operation to the section, paragraph, <br />sentence, clause, phrase, term, provision or part thereof directly involved in the controversy in <br />which such judgment shall have been rendered. <br />SECTION 6: That this Ordinance shall take effect and be in force from and after the <br />earliest period allowed by law. <br />PASSED: Vr' 4c�( r_ <br />2 <br />First Reading: <br />Second Reading:- 13 <br />Third Reading: -7,- <br />Committee: );11:r,-41 <br />, <br />
