?? . . ? <br />F <br />SECOND SUPPI,F,MI:N'lAI, AGREEMENT <br />THIS SECOND SUPPLF,MENTAL AGRF:LMENT, made and entered into <br />I this <br />day of <br />, 1982, by and between the <br />CITY OF NORTH OLMSTED, OHIO, (hereinafter referred to as "City"), <br />m i <br />duly authorized by Ordinance No. , passed by its <br />ICouncil on <br />; and CUYAHOCA COUNTY, OHIO, <br />(hereinafter referred to as "County"), duly authorized by a <br />IResolution adopted by its Board of Commissioners on <br />W I T N E S S E T H: <br />WHEREAS, On April 15, 1965 and May 23, 1974, the City and <br />the County entered into Agreements providing £or the City to <br />accept, receive, transport and dispose of sanitary sewage and <br />waste originating in an area of Olmsted Township, copies of <br />which Agreements are attached hereto and marked Exhibits "A" and <br />"B" , and <br />WHEREAS, the Agreements provided that the City shall have <br />Ithe right, but not oftener than once within each five year period <br />Ifxom the date'of the original Agreement (April 15, 1965), to <br />establish, with the approval of the County, a revised schedule <br />i <br />of rates and charges applicable to users of the County area <br />Isewer, and <br />WHEREAS, the increased costs of operation arid maintenance of <br />Ithe North Olmsted Wastewater Treatment Plant have been allocated <br />Ito the various entities being served by the City's treatment <br />Ifacilities, and the allocation to the County for the area served <br />lreauires that rates and charges be increased.
