. f <br /> <br />Bx . <br />..?,, <br />CITY 0F NORTH OLMSTED <br />ORDINANCE N0. 82- 159 <br />AN ORDINANCE ENACTING A NEW CHAPTER 559 OF THE <br />CODIFIED ORDINANCES OF THE CTTY OF NORTH OLMSTED <br />ENTITLED "FALSE ALARMS AND MALFUNCTIONING ALARM <br />SYSTEMS". <br />WHEREAS, false alarms and malfunctioning alarms are basically <br />attributed to three factors, namely: (1) user error and negligence, <br />(2) poor installation or servicing, and (3) faulty equipment, and <br />WHEREAS, great personal risk is involved to officers, other <br />drivers, and by-standers when officers are involved in a high- <br />speed response to an alarm, and <br />WHEREAS, it is the objective of the City of North Olmsted to <br />reduce the number of false or malfunctioning alarms to which police <br />officers respond, and <br />WHEREAS, this Ordinance constitutes an emergency measure <br />necessary for the public peace, health, welfare and safety and <br />for the usual operation of a municipal department. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA, AND STATE OF OHIO: <br />SECTION l: That the Codified Ordinances of the City of North <br />Olmste e an are hereby amended by creating a new Chapter 559 <br />entitled "FALSE ALARMS AN D MALFUNCTIONTNG ALARM SYSTEMS", which <br />said Chapter shall read as follows: <br />CHAPTER 559 <br />FALSE ALARMS AND MALFUNCTIONING ALARM SYSTEMS <br />559.01 PURPOSE <br />Although an alarm system is important as a deterrent to unlawful <br />entry, continued malfunctioning or employee error compromise the <br />effectiveness of the system. Freauent response by the police to <br />these false alarms is not only expensive, but also creates a risk <br />of injury to the responding officer and others and a risk of <br />damage to property.. Based upon these considerations, the purpose <br />o£ this Ordinance is to impose more drastic controls on alarm <br />subscribers and users. <br />559.02 DEFINITIONS <br />(a) "False Alarm" - means any security signal communicated to <br />the North Olmsted Police Department which is not in response <br />to actual or attempted burglary, holdup, assault, unlawful <br />entry or other bona fide emergency requiring immediate police <br />response. False alarms include negligently or accidently <br />activated signals; signals which are the result of faulty, <br />malfunctioning or improperly installed or maintained eauipment; <br />signals which are the result of improperly installed, secured <br />or maintained windows, doors or similar general areas of the <br />building; and signals which are purposely activated to summon
