. . . <br />CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82-159 <br />PAGE S. <br />559.09 REVOCATION OF PERMITS <br />.? <br />(a) Failure to comply with any provision of this Ordinance may <br />result in revocation of the subscriber's or user's permit. <br />(b) Grounds for revocation may be, but are not limited to: <br />(1) Pailure to properly maintain an installation, <br />(2) When the number of false alarms for an instal- <br />lation equals ten (10) in any twelve (12) <br />month period. <br />(c) The Chief of Police shall serve written notice upon the <br />permit holder of intent to revoke the permit. Such <br />notice shall be given not less than seven (7) days <br />prior to revocation. Such notice shall state the right <br />of the permit holder to appeal to the Safety Director <br />within fourteen (14) days from the date of the notice. <br />(d) If an appeal is filed in writing within fourteen (14) <br />days, the Safety Director shall hold a hearing on the <br />matter and shall xender a decision on the basis of the <br />facts presented. In the event no appeal is filed, the <br />Chie£ of Police shall transmit all pertinent information <br />to the Safety Director who shall cancel the permit. <br />(e) The permit holder may have an attorney present at the <br />hearing if so desired. The administrative remedies must <br />be exhausted before judicial procedures can begin. <br />(f) Upon revocation of the permit, the user or subscriber has <br />twenty (20) days to disconnect the alarm system or show <br />good cause for an extension of this time to the Safety <br />Director. <br />(g) Operation of an alarm system or failure to disconnect an <br />alarm system after revocation of the permit is in violation <br />of this Ordinance. <br />559.10 DUTIES OF ALARN1 SUBSCRIBERS OR USERS <br />(a) It shall be the responsibility of alarm subscribers or users <br />to instruct any employees or others who may have occasion to <br />activate an alarm that alarm systems are to be activated <br />only in emergency situations to summon an immediate police <br />response. Alarm subscribers and users shall also instruct <br />appropriate employees as to the operatiQ.ri of the alarm <br />system; to include setting, activation and resetting of the <br />alarm. <br />(b) Alarm subscribers and users shall be responsible for seeing <br />that alarm systems are maintained in good working order and <br />that defects which could cause false alarms are promptly <br />repaired.
