<br />.? <br />annually commencing on the lst of April of each year during the <br />period that this Agreement is in effect. Such adjustment shall be <br />based upon the actual cost of operation, maintenance, replacement <br />and repair of the System in order to operate the System on a self- <br />sustaining basis. <br />(5) No party, including the City of North Olmsted, shall subsidize <br />the cost of operating, maintaining or repairing the System and <br />only the City of North Olmsted shall have any authority to approve <br />or disapprove the rate established for the next succeeding year. <br />(6) No group of users provided for by contract with the City of North <br />Olmsted shall pay a disproportionate share of the capitalization <br />costs of the System. <br />(7) The rates established herein shall not include the cost of <br />construction or maintenance of local sewer lines installed and <br />maintained by communities outside the corporate limits of the <br />City of North Olmsted. <br />B. Over and above the rates and charges established immediately above, <br />there may be established in special instances and upon special <br />agreement between the City of North Olmsted and the owner of any premises <br />served by the System, such additional charges for industrial wastes of <br />unusual strength or composition which are accepted by the City for <br />treatment as may be determined to be proportionate. <br />Section 4: That the contractor will adopt the necessary legislation authorizing <br />the Cleveland Water Department to bill all Cleveland water users in the Service <br />Area quarterly. <br />-3-
