Section 1: That North Olmsted will extend the use of its Wastewater Treatment System to Olmsted Township and will accept and treat all wastewater collected in such sanitary sewers as Olmsted Township may cause to be constructed and connected and delivered to North Olmsted sanitary sewage collection system, from the area hereinafter described in the next succeeding paragraph. Section 2: That it will permit property located in Olmsted Township as outlined in the diagram attached hereto shaded in red and marked as Exhibit "I", and hereinafter referred to as the "Service Area", to connect to such sanitary sewers upon payment of charges as hereinafter set forth. Section 3: That for and in consideration of the above services the Contractor hereby covenants and agrees as follaws: A. That is will reimburse North Olmsted for wastewater treatment at the following rates and in the following manner; (1) Each user of the system shall pay the same rate for its respective classification as is established for North Olmsted users commencing upon the establishment of a new rate schedule for the City of North Olmsted. All of part of the debt service portion of the charge may be paid by users within the City of North Olmsted through taxes. (2) The City of North Olmsted shall, upon request of the Contractor, permit such officials of the Contractor to review sewer facilities budgets, operating costs and financial information used to calculate and determine the rates for usage of the Wastewater Treatment System. (3) Contractor agrees that Chapters 911 through 915 of the Codified Ordinances of the City of North Olmsted shall be in force and apply to any property served by the North Olmsted System. A copy of the said Chapters shall be attached to the executed copy of this Agreement and made a part hereof as though fully rewritten hereat. (4) The rate established for users of the System shall be adjusted -2-
