<br />AN ORDINANCE ESTABLISHING A NEW SECTION 1363.13
<br />OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH
<br />OLMSTED TO BE ENTITLED "REMOVAL OF WEEDS AND
<br />NOXIOUS VEGETATION" OF CHAPTER 1363 ENTITLED
<br />"REAL PROPERTY MAINTENANCE CODE".
<br />WHEREAS, the Council in adopting Chapter 1363 provided
<br />for the general maintenance of real property. More specifically,
<br />however, said Chapter is designed to enforce a maintenance code
<br />against commercial property, and
<br />WHEREAS, it is the experience of this Council that there
<br />does not presently exist any comprehensive provision for the
<br />maintenance of all real property in the City as it relates to
<br />the problem of noxious weeds and vegetation, and
<br />WHEREAS, it is the desire of this Council to apprehensively
<br />treat the subject of the removal of weeds and noxious vegetation
<br />in a separate section which s}iall apply to all property in the
<br />City, both commercial and residential.
<br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY
<br />OF NORTH OMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO:
<br />SECTION l: That there is hereby established a new Section
<br />1363,13 o the Codified Ordinances entitled "Removal of Weeds and
<br />Noxious Vegetation" which new Section shall read as follows:
<br />1363.13 REMOVAL OF WEEDS AND NOXIOUS VEGETATION
<br />(a) Every owner, occupant or person in control of
<br />any lot or lands, residential, commercial or industrial,
<br />situated with the City shall cause such lot or lands to
<br />be kept free from Russian, Canadian or common thistle,
<br />briars, wild lettuce, wild mustard, wild parsley, ragweed,
<br />milkweed, ironweed, chickweed, wild garlic, auack grass,
<br />dodders, wild carrot, common cockle, docks, chicory and
<br />all other noxious weeds and bushes, wild shrubs or other
<br />growth growi.ng or being upon such lots or lands as afore-
<br />said.
<br />Whenever grasses, noxious vegetation, bushes, wild
<br />shrubs or other growth have reached the height of eight
<br />(8) inches or more, or bloom, and/or the density of
<br />growth is such as to constitute a nuisance, in the
<br />judgment and opinion of the Service Director, such owner,
<br />occupant, or person in control of any such lot or lands
<br />shall cause such grasses, noxious vegetation, bushes,
<br />wild shrubs or other growth to be cut and removed,
<br />either by spraying with a chemical compound approved by
<br />the Service Director, or by cutting, burning, digging
<br />under or by any other method approved by the Director.
<br />Every owner, occupant or person in control of any
<br />lot or lands situated within the City who fails to comply
<br />with the provisions of this section shall be gui.lty of a
<br />misdemeanor and upon conviction shall be fined as provided
<br />for by Section 1363.99.
