CITY OF NORTH OLMSTED <br />ORDINANCE N0. 82- 100 <br />PAGE 2. <br />Failure to Remove; Costs <br />(b) To comply with such notice, the Director of <br />Service shall then cause such noxious weeds and/or <br />excessi.ve growths to be destroyed by any of the <br />methods set forth in this section and for such <br />purpose he may employ the necessary labor and use <br />the necessary materials to carry out the provisions <br />of this section. He shall keep a complete and <br />accurate record of the man-hours of labor employed, <br />machine-hours used, if any, and cost of materials <br />used, if any. <br />Upon completion of such work by the City, a <br />statement by the Finance Director shall be forwarded <br />to the owner at his tax mailing address as shown in <br />the records of Cuyahoga County, by certified or <br />registered mail. If such notice be not delivered <br />to such owner, it shall then be advertised in a news- <br />paper of general circulation in the City, once weekly <br />for two (2) weeks. <br />Such statements shall include the cost of materials <br />used, and the cost o£ machine-hou.rs used. Work per- <br />formed by the City pursuant to this section shall be <br />billed at fifty dollars ($50.00) per hour which in- <br />cludes manpower and equipment. Additionally such <br />statements shall include such overhead as may be <br />applicable, the cost of service, whether personal <br />service or by advertising, two and one-half dollars <br />$2.50) per lot or parcel for certification of tax <br />lien, the charge of the Auditor of Cuyahoga County <br />for servicing the lien, and all other necessary and/or <br />incidental expenses incurred. The owners of such <br />lots shall have thirty (30) days during which the <br />charges may be paid, and if not paid at the expiration <br />of such thirty-day period, the cost shall thereupon <br />constitute a lien upon the lots and lands so benefited <br />and a tax shall be levied therefor. The Finance <br />Director shall certify such tax lien to the Auditor of <br />Cuyahoga County. <br />The Auditor of Cuyahoga County shall place such <br />lien for collection upon the tax duplicate for the tax <br />collection next following; the charges due as a lien <br />upon the lots and lands so benefited shall be collected <br />during the earliest tax collection period next following. <br />SECTION 2: That this Ordinance hereby repeals any ordinance <br />or parts o or inances inconsistent herecaith. <br />SECTION 3: That this Ordinance shall take effect and be <br />in force at the earliest period allowed by law.
