- CTTY OF NORTH OLMSTEL <br />ORDINANCE N0. 82-49 <br />•PAGE THREE. <br />L. Any time a patrolman is required to temnorarily take charge of <br />a shift command, said patrolman shall be naid a premium of one additional <br />hour at a straight time rate f_or each day 'Ze is required to do so. <br />M. In the event that a full-time sworn employee of the Police De- <br />partment of the City of North Olmsted should be injured while in the line <br />of duty due to a sudden and accidental occurence and such injury has so <br />incapacitated said member of the Police Department that he is temporarily <br />unable to work, then the Director of public Safety, after determining that <br />said injury is work related and is of a temporary nature, may authorize <br />full payment of the employee's regular salary for a neriod of not more than <br />ninety days. If, after said ninety day period, said employee is sti11 tem- <br />porarily incapacitated, then the Director of Public Safety shall recommend <br />to Council whether or not to continue said salary. Council shall forthwith <br />review the matter and by majority vote determine whether the emnloyee shall <br />continue to receive his full salary during recuneration. <br />For the purDoses of this Paragraph, a sudden and accidental injury <br />shall include such incidents as an automobile accident, assault and battery, <br />gun shot wound and the like. It shall not be considered as sudden and ac- <br />cidental if injury or incapacity results from the lifting of objects, <br />slipping, tripping or falling, heart failure or heart attack. <br />Any full time siaorn employee of the Department who qualifies for <br />benefits under Paragranh M hereof shall be required to pay over to the City <br />any amounts received from the Bureau of Workmen's Compensation as supble- <br />mental wages. Further, if at any time the City determines, on the basis <br />of inedical evidence, that an employeee is nermanently disabled and will no <br />longer be able to carry on his duties then the City may terminate bayments <br />and insist that the employee go on aDension program. Any employee who <br />aualifies for the benefits under this paragraph shall not have his ac- <br />cumulated siclc time reduced because of a qualified accidental injury which <br />occurred while in the line of duty. <br />All full-time sworn Police Officers sha11 receive one eight (8) <br />hour day off with pay for each six (6) consecutive months of unused sick <br />time off. These off days shall be determined by the Chief of Police. <br />SECTION 3: That the employees of the Police Department of the City <br />of North Olmsted be reimbursed, not to exceed three dollars ($3.00) per <br />day, for per diem expenses while in attendance at the Police Training <br />School established by the Cuyahoga County Commissioners at Case Western <br />Reserve University, which school is for a two-week neriod with ten days <br />class attendance. <br />SECTION 4: That the Rules and Regulations established by virtue of_ <br />the adoption o Ordinance No. 76-157 on November 3, 1976, and revised sec- <br />tions shall remain in full force and effect and said Rules and Regulations <br />shall be adonted with this Ordinance and the same are made a part hereof <br />by reference. <br />SECTION 5: Except as otherwise provided herein, all other Ordinances <br />or Resolutions, or parts of Ordinances or Resolutions, or parts of Ordinances <br />or Resolutions inconsistent herewith to the provisions of this Ordinance, <br />and especially Ordinance No. 80-27, are hereby repealed. <br />SECTION 6: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, <br />safety and welfare, and for the further reason that it is immediately nec- <br />essary for the continuity of services o_f the safety forces of the City, <br />and further provided it receives the affirmative vote of two-thirds of all <br />members elected to Council, it shall take eff.ect and be in force immediately <br />upon its passage and anproval by the Mayor. <br />PASSED : ?? /A /9A? <br />ATTEST: v <br />LORENCE F.
