V-CITY OF NORTH QLMSTED <br />ORDINANCE N0. 82-50 <br />'PAr,E THREE. <br />J. In the event that a member of the Fire Department of the City <br />of North Olmsted should be injured while in the line of duty due to a <br />sudden and accidental occurrence and such injury has so incapacitated <br />said member of the Fire Department that he is temporarily unable to work, <br />then the Director of Public Safety, after determining that said injury is <br />work related and is of a temnorary nature, may authorize full payment of <br />the employee's reQular salary for a period of not more than ninety (90) <br />days. If after said ninety (90) day period, said ernployee is still <br />temporarily incapacitated, then the Director of Public Safety shall <br />recommend to Council whether or not to continue said salary. Council shall <br />forthwith review the matter and by majority vote determine whether the <br />emnloyee shall continue to receive his full salary during recuneration. <br />For the purpose of this paragraph, sudden and accidental injury <br />shall include such incidents as injury resultina from a motor vehicle <br />accident; smoke inhalation; burns; falling debris or collapse of <br />building; slipping; tripning and falling, and the like. It shall not be <br />considered a sudden or accidental injury or incapacity resulting _from <br />the lifting of objects, heart failure or heart attacks. <br />Any member of the Department who qualifies for benefits under <br />Paragraph 1 hereof shall be required to pay over to the City any amounts <br />received from the Bureau of Workmen's Comnensation as supnlemental wages. <br />Further, if at any time the City determines on the basis of inedical <br />evidence that an employee is permanently disabled and will no longer be <br />able to carry on his duties then the City may terminate payments and <br />insist that the emplbyee Qo ?n a pension program. Any employee who <br />Qualifies for the henefit ulfler this paragraph shall not have his accumu- <br />lated sick time reduced because of a qualified accident injury which <br />occurred while in the line of duty.:: <br />_SECTION 3: That the emnloyees of the Fire De??artment of the City <br />of North Olmsted be reimbursed, not to exceed Three Dollars ($3.00) per <br />day for per diem expenses while in attendance at the Firemen's Training <br />School established by the State of Ohio at a place designated by the <br />Fire Chief, which school is for a five (S) week neriod laith twenty-£ive <br />(25) days of class attendance rec?uired. ? <br />SECTION 4: That there is hereby established certain rights, rules, <br />and regulations with respect to employee grievance procedure. Said <br />grievance procedure is set f_orth in Exhibit "A" which is attached hereto <br />and made a nart hereof. Said grievance procedure shall be incornorated <br />within the rules promulgated and adopted by the Chief of the Fire <br />Department and Safety Director for the governing of the Fire Denartment <br />in effectuating Civil Service Laws of the State of Ohio and the rules and <br />regulations of the North Olmsted Civil Service Commission. <br />SFCTION 5: That the Clerk of Council be, and she is hereby directed <br />to forward a copy of this Ordinance to the Director of Finance in order <br />that the Director of Finance can pay the compensation, as hereinabove set <br />forth, and a copy of this Ordinance shall beforwarded to the Fire Chief. <br />SECTION 6: That Ordinance No. 80-91, adopted July 28, 1980, is <br />hereby repealed and any other Ordinances or Resolutions or parts of Ordin- <br />ances or Resolutions inconsistent herewith are hereby repealed with the <br />effective date of this Ordinance. <br />SECTION 7: That this Ordinance is hereby declared to be an emergency <br />measure immediately necessary for the preservation of the public health, <br />safety and welfare, and £or the further reason that it is immediately <br />necessary for the continuity of service of the safety forces of the City, <br />and further provided it receives the affirmative vote of two-thirds of <br />all members elected to Council, it sha11 take effect and be in force <br />immediately upon its passage and approval by the Mayor.
