Sherman <br />Sunrise Development Company <br />Rini Realty Company <br />Rini Realty Company <br />Permanent Parcel Nos. <br />234711-1 through 18 <br />234-11-49 through 59 <br />234-11-88 through 104 <br />234-11-131 through 139 <br />Part of 234-13-9 <br />234-9-3 <br />234-9-4 <br />(hereinafter re£erred to as the "property owners"). <br />WHEREAS, the property owners have, by their Petition dated <br />as of April 23, 1982 (the "Petition"), requested that the Council <br />of the City open a public street, running southerly from Lorain <br />Road, thence easterly to a cul-de-sac terminus, in the area <br />between Lorain Road and Interstate 480, immediately to the east <br />of the westerly corpoxation line of the City, and for the improve- <br />ment of said street by grading, draining, curbing, paving and <br />installing a water main, storm and sanitary sewers, together <br />with the necessary appurtenances thereto (hereinafter referred <br />to as the "Project"), and to assess the entire cost thereof in <br />proportion to the benefits which may result therefrom upon the <br />lots and lands bounding and abutting said street, all subject to <br />certain conditions set foxth in the Petition, and <br />WHEREAS, the City will incur certain preliminary planning, <br />engineering, and legal expenses prior to receiving bids for the <br />construction o£ the project, and <br />WHEREAS, the City will incur these expenses in reliance <br />upon the property owners' promises, contained in the Petition, <br />to permit the City to levy and collect assessments against the <br />property owners' benefiting properties in order to fully recover <br />all of its costs incurred in connection with the project, and
