Council Minutes of 5-21-2019 <br />cause. The City appealed the decision to the panel and they did not agree with the <br />City. It was appealed to the Court of Common Pleas and they did not agree with <br />the City. Now, half a decade after this all started the Eighth District Court of <br />Appeals decision affirmed the decision of the trial court. So the City did not win <br />this issue. Mr. Fox stopped collecting any benefit he could get from <br />unemployment long ago. However, there is the point of it. The Law Department is <br />going to defend a position because we believe it is the right position, not because <br />it would be expedient otherwise. Anyone who gets terminated under <br />circumstances such as his, the department will do anything we have to do to <br />ensure it is fully litigated. Director Gareau said he does not think this is right, <br />however, he said he is not a judge and does not sit in judgment on these <br />proceedings. He said he isn't surprised or necessarily disappointed, but he wants <br />Council to know it's the point of it. It's about going out and making sure there is a <br />record of what the City did. It's on the record forever about what the City did and <br />conversely it's how he handled himself. Director Gareau says he thinks it's <br />closed. The principle behind this will go on and the Law Department is going to <br />do the right thing. <br />Councilman Brossard Chairman of the Public Safety, Health and Welfare Committee: <br />The Public Safety, Health and Welfare Committee met on Tuesday, May 21, 2019 at 7:03 <br />p.m. Present were committee members Brossard, Williamson and Limpert; Council <br />members Glassburn, Hemann, Kearney and Schumann; Mayor Kennedy, Director of <br />Human Resources Gallo, Director of Safety & Service Glauner, Youth and Family <br />Service Administrator Allegra and guests. <br />• Discussed was Ordinance 2019-59. An Ordinance establishing a new and revised <br />fee schedule for participation in the City's Community Diversion Program <br />("CDP") and declaring an emergency. This will revise the current fee schedule <br />and include language to ensure the Juvenile Traffic Intervention Program and the <br />Community Diversion Program remain separate programs. The Community <br />Diversion Program was established in 1998, and is no longer a first offense <br />diversion program. It is also a repeat offender program. Furthermore, felony level <br />cases such as sexting, THC vaping and misuse of credit cards are now being <br />addressed by this program. Due to these changes, revising the flat rate $80 fee to a <br />range of $80 to $120 would allow for more flexibility to have higher fees for <br />repeat offenders and felony level cases, which also require closer monitoring and <br />more interventions.
