Council Minutes ol'6-4-2019 <br />to repair, replace or construct sidewalks adjacent thereto, as such improvements <br />were deemed necessary and installed pursuant to the 2018 Sidewalk Program in <br />the City of North Olmsted. This is a re -read of Ordinance 2019-53, which did not <br />complete the three readings. "There were no changes from the previous legislation <br />and it had been discussed in several meetings. The committee voted to <br />recommend to Council 3-0. <br />AUDIENCE PARTICIPATION <br />Ray Daniels <br />5932 Gareau Drive <br />Mr. Daniels said there is a problem behind his home with the swale. Ile said the function <br />is to run water off the back of the lots between Stearns Road and Gareau. 1 -Ie said for the. <br />29 years he has lived in his home nothing has been done with this area. Mr. Daniels said <br />he has had a few conversations with the Mayor and Councilmembers over the last half <br />dozen years or so and still nothing has been done. lie said he is concerned what is <br />happening there is going to be a terrible health hazard and potentially lead to a death. He <br />said three years ago a two year old girl almost died back there. Mr. Daniels said as of <br />today Ile has water 16 feet into his backyard. He estimated the houses on Stearns had <br />water 45 feet into their yards when it was raining last week. He said it turns into a pond <br />and ducks swim in it. He doesn't know, which way the water is supposed to flow, but the <br />situation is because people on either end have tilled in their swales and built them up <br />which does not allow the water to run off. He said he knows there are ordinances that will <br />require the people to fix the issue. Mr. Daniels said he understands it may not be the <br />current homeowner that caused it and they were unaware when they bought the home <br />what the previous owners did. He said there is a constant smell and mud. The mosquitos <br />are so bad in the summertime he can't go in his backyard after 3 p.m. He said because of <br />the water backed up in his own yard his dog got stuck in the mud a couple days ago. Mr. <br />Daniels said he wants to make a proposal since the City seems reluctant to enforce the <br />rules or to help correct the. situation. 1 -le said he wants to go back into the swale and <br />install culverts or a catch basin that will let the water drain in and put electric pumps and <br />pump the water out on Gareau or Stearns. He said the electric could be hooked up to his <br />house. Ile said he'd pay for it and put it oil his electric bill as he doesn't want to see <br />anyone get hurt or worse. <br />Mayor Kennedy ask Mr. Daniels to meet with him tomorrow to discuss the issue. <br />LEGISLATION <br />Ordinance 2019-59 introduced by Mayor Kennedy was given its third reading, An <br />Ordinance establishing a new and revised lee schedule for participation in the City's <br />Community Diversion Program (-CJ)P") and declaring an emergency. Councilman <br />Brossard moved for adoption. The motion was seconded by Councilman Kearney and <br />passed unanimously. <br />Roll Call: <br />Yes: Brossard, Kearney.
