Mixed Use District <br />E. Requirement of Plans to Conform. All plans and specifications for the development of a <br />parcel, or any portion thereof, shall conform to the detailed development plan as approved <br />under the provisions of subsection (D) hereof and shall be submitted to the Building <br />Commissioner in accordance with the ordinances of the City. <br />(Ord. 90-125. Passed 5-21-91.) <br />Section 1149.09 Building Permit and Certificate of Occupancy <br />No building permit for the improvement of a parcel, or any portion thereof, or for the erection of <br />any building shall be issued unless and until the detailed development plan shall have been <br />approved in accordance with the provisions of Section 1149.08(D). If and when such proposed <br />detailed development plan shall have been approved in accordance with Section 1149.08(D), <br />the Building Commissioner shall be so notified and he shall then issue the necessary building <br />permits and certificates of occupancy. <br />(Ord. 90-125. Passed 5-21-91.) <br />Section 1149.10 Amendment to Plans <br />At any time after the approval of the preliminary land use plan or the detailed plan for <br />development, the owner or owners may make a request for an amendment, in which case the <br />following procedure shall govern: <br />A. If the amendment deals with the preliminary land use plan, such request shall be filed with <br />Council and acted upon by Council. <br />B. If the amendment deals with the detailed development plan, it shall be filed with the <br />Planning and Design Commission and a copy filed with the Clerk of Council. The <br />Commission shall have the power to approve or deny such amendment unless Council, by <br />resolution, shall have disapproved the same prior to action by the Commission. <br />(Ord. 90-125.
