Mixed Use District <br />such parcel is part of a contiguous undeveloped land belonging to the same owners, the <br />preliminary plan shall include all such undeveloped land. The preliminary pians shall set forth <br />the proposed public streets and areas to be developed to specific land uses. Council shall, upon <br />the receipt of the preliminary use plan, refer the plan to the Planning and Design Commission <br />for its recommendation. The Commission shall, within 60 days from the date of referral by <br />Council, recommend the approval, modification, amendment or rejection of the preliminary land <br />use plan. In the event the Commission does not within such 60 day period take any action, it <br />shall be assumed to have approved the preliminary land use plan. Upon receipt of the report <br />and recommendation of the Commission or upon the expiration of such 60 day period, Council <br />may approve, or approve as modified or amended, or reject the preliminary land use plan. No <br />action shall be taken for the development of the parcel until Council approval, and then only in <br />accordance with such approval. <br />(Ord. 2002-118. Passed 10-1-02) <br />Section 1149.08 Detailed Development Plan <br />A. Proposal. The owner or owners of any land for which a preliminary land use plan has been <br />approved pursuant to Section 1149.07, may submit a proposal for a detailed development <br />plan of such land. Any such proposal shall be filed with the Building Commissioner and shall <br />be submitted to the Planning and Design Commission for its approval. Such detailed <br />development plan shall be accompanied by and supported by development drawings, <br />including site plans indicating specific land uses, location of buildings, off-street parking <br />areas, loading areas, building architectural sketches and preliminary landscape plans. There <br />shall also be submitted data showing the volume of traffic expected to be generated by the <br />development, together with the plan for handling such traffic. When the plan provides for <br />only a partial development of a parcel, sufficient planning for the remainder of the parcel <br />shall be submitted to permit evaluation of the development of the entire parcel. <br />B. Planning and Design Commission Approval. Prior to approval of an application for a <br />detailed development plan, the Commission may request such changes in the application as <br />it deems necessary to bring such plan within the spirit of and in keeping with the <br />requirements of this chapter and within the limitations of the preliminary land use plan that <br />has theretofore been approved. <br />C. Grounds for Planning and Design Commission Approval. A proposed detailed <br />development plan shall not be rejected for reasons based on personal preference as to taste <br />or choice of architectural style but only for such inappropriateness of design or appearance <br />as could be expected beyond a reasonable doubt to provoke harmful effects upon adjoining <br />property. If the Commission finds that such proposed detailed development plan is in <br />conformance with the preliminary land use plan theretofore approved by Council and is in <br />accordance with the provisions of this chapter and in the spirit and keeping with this district, <br />and meets all the conditions which it in its discretion may have imposed, the Commission <br />shall approve the detailed development plan and notify Council of such action. <br />D. Council Approval. The proposed detailed development plan, so certified by the <br />Commission, shall not become effective unless and until it shall have been approved by <br />Council, provided, however, that in the event Council should take no action in approving or <br />disapproving such plan, as certified by the Commission, within 30 days from the date of the <br />receipt of such certification, the action of the Commission in approving such plan shall <br />become in full force and effect on the day next succeeding the expiration of the 30 day <br />period. <br />Page 1149-6 Cite... _�. <br />North Olmsted Zoning Code <br />
