Mixed Use District <br />5. Local retail. The following local retail uses shall be permitted, but subject to the <br />provisions of Subsection 1149.041: <br />a. The retail sale of baked goods, confectionery, dairy products, delicatessen, fruits, <br />vegetables, groceries, meats or beverages, <br />b. The sale of books, magazines, newspapers; tobacco products, drugs, flowers, gifts; <br />music, photographic equipment and goods, sporting goods or stationery; <br />c. The sale of dry goods, apparel, furniture, china, floor coverings, household goods, <br />electronics and variety merchandise; <br />d. The sale of hardware, household appliances, paint, wallpaper, materials and objects <br />for interior decorating; <br />e. Printing shops and graphic arts facilities; <br />f. Full-service restaurants, but excluding: <br />1. Places with drive-in facilities; or <br />2. Any place providing dancing or entertainment; <br />g. Barber shops, beauty shops, custom tailors, laundry or dry cleaning agencies where <br />none of the processing is done on the premises, self-service laundries and dry <br />cleaning or shoe repair shops; <br />h. Banks and other financial institutions; <br />i. Any other local retail or service use which the Commission determines to be: <br />1. Similar in character and impact to the listed permitted uses; <br />2. Appropriate to the proposed location; <br />3. Consistent with the spirit and intent of Mixed Use District D; and <br />4. Will not have an adverse impact upon adjacent residential properties. <br />E. Any land within the City zoned Mixed Use District A before the adoption of this Zoning Code <br />shall remain designated Mixed Use District A. Further, any land zoned Mixed Use District B <br />prior to the adoption of this Zoning Code, shall be hereinafter designated Mixed Use District <br />C. <br />(Ord. 2002-118. Passed 10-1-02.) <br />Section 1149.04 Development Regulations for Mixed Use Districts A, B and C <br />A. Phased Development. A development area in a Mixed Use District may be developed by <br />phases if approved by the Planning and Design Commission. <br />B. Streets. Access and interior roads and streets shall be properly related to any existing or <br />planned public street so as to promote safety and minimize traffic congestion. Dedication of <br />interior roads for public use as the Commission shall deem essential shall be a condition of <br />approval of the plan. <br />C. General Setback. Each nonresidential building shall be located at least 100 feet from every <br />dedicated street right-of-way and boundary line of the mixed use development area. Such <br />buildings shall have a minimum 25 feet of landscaped area between all boundary lines, <br />other buildings, public streets, private streets and drives. <br />D. Development Abutting Residence District. Portions of any development area within 50 <br />feet of property which is zoned for any Residence District shall remain vacant and be <br />improved with landscape planting. <br />E. Buildings and Structures.
