WHEREAS, given the emergency nature of the situation and the potential for a rapid <br />spread of COVID-19, changes in staffing, hours. wages, benefits or other terms and conditions of <br />employment for City of North Olmsted employees may need to be re -negotiated with the <br />bargaining unit employees on a temporary basis in order to maintain the public health, safety and <br />welfare, and <br />WHEREAS, this Council wishes to enact legislation to provide the Mayor of the City of' <br />North Olmsted with temporary, emergency authority to enter into contracts on behalf of the City <br />ofNorth Olmsted to maintain and preserve the public health, safety and welfare. <br />NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED. COUNTY OF CUY.AHOGA, AND STA TE OF OHIO: <br />SECTION 1: This Council declares that the COV ID -19 outbreak in the State of Ohio is a <br />real and present public health emergency in the City of North Olmsted requiring immediate action <br />in order to protect the public, health, safety and general welfare. <br />SECTION 2: In order to ensure the continued, uninterrupted provision of services during <br />this public health emergency, this Council does hereby, pre -authorize the Mayor to enter into <br />contracts for the purchase of goods in excess of $50,000.00 without public bidding, as an <br />emergency exception to public bidding, <br />SECTION 3: "file authority of the Mayor to execute contracts up to the sum of $5,000.00 <br />without Council approval, as set forth in North Olmsted Codified Ord. § 131.05(a)(1), be and the <br />same is hereby increased to $100,000.00. All other provisions of §131.05(a) ( I ) shall remain in <br />effect. <br />SECTION 4: The Mayor is authorized to enter into any, and all necessary personal service <br />contracts in an amount not exceeding $100,000.00 pursuant to the real and present emergency <br />exception to the formal RFP / RFQ process of Chapter 1 12, as identified in Section 1 12.10(a). <br />SECTION .5: The Mayor is authorized to negotiate all hours, wages, benefits or other <br />terms and conditions of employment with any Collective Bargaining Unit and to enter into any <br />temporary agreement necessary to maintain the public health, safety and welfare. <br />SECTION 6: Any contract entered into by the Mayor pursuant to the authority granted <br />by this Ordinance shall be approved by the Director of Law. <br />SECTION 7: This Ordinance shall be in effect for a period of one hundred and eighty <br />days (180) from its passage and approval by the Mayor or until repealed by this Council, whichever <br />occurs first. <br />SECTION 8: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it is immediately necessary that this legislation go into effect immediately in <br />orderto provide for continued provision of service during the COVID-19 public health emergency, <br />3 <br />
