WHEREAS, on March 12, 2020, Governor DeWine went further and signed an order <br />prohibiting mass gatherings in the State of Ohio, defined as 100 or more persons in a single room <br />or single space at the same time; and <br />WHEREAS, effective Monday, March 16, 2020, all K-12 schools were ordered closed to <br />students in Ohio through Friday, April 3, 2020. This order includes all public, community, and <br />private K-12 schools in the state. Additionally, colleges have been closing voluntarily and self - <br />quarantine efforts for those exposed to COV1D-19 or potentially exposed to the same are <br />underway: and <br />WHEREAS, in response to browing concern from state health experts, Governor DeWine <br />on March 15. 2020, ordered all restaurant and bar dining rooms closed in the State of Ohio: and <br />WHEREAS, this Council recognizes the urgency of this public health crisis and desires to <br />brant to the Mayor the contracting authority necessary to respond swiftly and appropriately to this <br />rapidly developing situation; and <br />WHEREAS, Article Vlll, Section 6 of the Charter of the City of North Olmsted, "Public <br />Bidding" provides as fellows; in pertinent part: <br />The Council may authorize expenditure of funds of the City in <br />amounts exceeding those provided for from time to time by the <br />general laws of the State of Ohio governing municipal corporations <br />without public bidding—during real and present emergencies in <br />order to immediately provide for the health, safety and welfare of <br />the residents of North Olmsted; and <br />WHEREAS, North Olmsted Codified Ord. § 131.05(a)(1). "Mayor's Contract Authority." <br />provides, in pertinent part, as fellows: <br />(a) The Mayor may execute any contract to which the City is a party without <br />obtaining authorization of Council if all of the following conditions exist: <br />(1) The contract does not involve an expenditure of City funds in excess of <br />five thousand dollars ($5.000); and <br />WHEREAS, North Olmsted Codified Chapter 112. "Personal Services Contracts." <br />establishes a procedure for obtaining contracts for personal services. That Chapter creates a time <br />consuming selection process for contracts above, and below, a $25,000.00 threshold. Section <br />112.10 sets forth exceptions to the Personal Services contract selection process when "[a]ny <br />personal services contract [is] determined by the director or board to be of an emergency nature <br />requiring immediate action" provided Council approves the exception to the process; and <br />WHEREAS, the City has multiple Agreements with employees who are members of <br />various bargaining units of the City ofNorth Olmsted: and <br />
