CITY OF NORTH OLMSTED ORDINANCE NO. 2020 - 55 By: Mayor Kennedy AN ORDINANCE AUTHORIZING THE MAYOR AND FINANCE DIRECTOR TO ENTER INTO AN AMENDMENT OF THE SEWER SERVICE AREA DEFINED BY EXHIBIT B OF THE SEWER SERVICE AGREEMENT WITH THE COUNTY OF CUYAHOGA, AS AMENDED AND RESTATED IN 2013, AND DECLARING AN EMERGENCY, AS AMENDED. WHEREAS, the City of North Olmsted previously negotiated amendment of and restated its Sewer Service Agreement with Cuyahoga County (dated 10/23/13), pursuant to authorization granted by Council by Ordinance 2013-88, in conjunction with capital improvements to the Wastewater Treatment Plant (WWTP), serving a portion of County's Sewer District No. 14; and WHEREAS, in order to accommodate residential development as proposed on John Road in Olmsted Township, discussions were commenced between the Cuyahoga County Engineer, the City of North Olmsted Engineer, in coordination with NOACA and the Olmsted Township Trustees, in order to propose that the City and the County of Cuyahoga (the County) agree upon amendment of the Service Area Map, defined and described by Exhibit B of the Sewer Service Agreement, in order to identify and include eight (8) additional parcels of land (64.9 acres), located on the south side of John Road in Olmsted Township, to be included within the North Olmsted Facility Planning Area (FPA) and also included within the sewer services provided by the North Olmsted WWTP; and WHEREAS, in response to requests from the County Engineers Office, by correspondence dated 11/1/19, the City Engineer confirmed and reported sufficient capacity at the North Olmsted WWTP to include the development known as the Sanctuary and Preserves of Olmsted (former Links golf Course) within the North Olmsted FPA and to further amend the Service Area Map (Exhibit B) of the Sewer Service Agreement with Cuyahoga County (dated 10/23/13); and WHEREAS, by Resolution No. 2020-16, the Northeast Ohio Areawide Coordinating Agency (NOACA), supported the recommendation to increase the Service Area Map by addition of the John Road development area, consisting of eight (8) parcels (64.9 acres) to be included in the North Olmsted FPA; and WHEREAS, engineering professionals representing the City and the County have studied and documented the North Olmsted FPA and Service Area Map as proposed by Exhibit B, a copy of which is attached, dated 4/24/20, to amend the Sewer Service Agreement, dated 10/23/16; and WHEREAS, this Council has determined to approve the further amendment of the Sewer Service Agreement, as Amended and Restated in 2013, in order to increase the service area as shown in revised Exhibit B, dated April 24, 2020.
