NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: The Mayor and the Director of Finance are authorized and directed to sign <br />and deliver, in the name of and on behalf of the City and in their official capacities, an Amended <br />and Restated Sewer Service Agreement between the City and the County of Cuyahoga in <br />substantially the form now on file with the Clerk of Council. That Agreement is approved, together <br />with any changes or amendments, specifically the revised Exhibit B, and further as that are not <br />inconsistent with this ordinance and not substantially adverse to the City and that are approved by <br />the Mayor, the Director of Finance and the Director of Law on behalf of the City, all of which shall <br />be conclusively evidenced by the signing of the Agreement or amendments thereto and written <br />approval as to form by the Director of Law. The Mayor, the Director of Law, the Director of <br />Finance and other appropriate City officers are also authorized and directed to take any and all other <br />actions as are necessary and appropriate to carry out the obligations of the City under the <br />Agreement and are consistent with this ordinance. <br />SECTION 2: This Council finds and determines that all formal actions of this Council and <br />of any of its committees concerning and relating to the passage of this ordinance were taken, and <br />that all deliberations of this Council and of any committees that resulted in those formal actions <br />were held, in meetings open to the public in compliance with the law. <br />SECTION 3: That this Resolution is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety and welfare and for the <br />further reason that it will more expeditiously realize, secure and receive needed funds for the <br />Sewer Revenue Fund; and further provided that it receives the affirmative vote of two-thirds of <br />all members of Council, it shall take effect and be in force immediately upon its passage and <br />approval by the Mayor. <br />PASSED: J ✓ Z, <br />A TTEST: <br />6� <br />CHARLES *MASSA OL 0 11 <br />Clerk of Council <br />APPROVED: b JZ✓2Zo <br />First Reading: 202,r5 <br />Second Reading:S�l 1-?c-6�� <br />Third Reading: <br />Committee: _ nv;fcx\y-N" el <br />NICOLE DAILEYJO E <br />President of Council <br />APPROVED AS TO LEGAL FORM.- <br />A/ <br />ORM: <br />A/ Michael R.
