NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: The Mayor and the Director of Finance are authorized and directed to sign and deliver, in the name of and on behalf of the City and in their official capacities, an Amended and Restated Sewer Service Agreement between the City and the County of Cuyahoga in substantially the form now on file with the Clerk of Council. That Agreement is approved, together with any changes or amendments, specifically the revised Exhibit B, and further as that are not inconsistent with this ordinance and not substantially adverse to the City and that are approved by the Mayor, the Director of Finance and the Director of Law on behalf of the City, all of which shall be conclusively evidenced by the signing of the Agreement or amendments thereto and written approval as to form by the Director of Law. The Mayor, the Director of Law, the Director of Finance and other appropriate City officers are also authorized and directed to take any and all other actions as are necessary and appropriate to carry out the obligations of the City under the Agreement and are consistent with this ordinance. SECTION 2: This Council finds and determines that all formal actions of this Council and of any of its committees concerning and relating to the passage of this ordinance were taken, and that all deliberations of this Council and of any committees that resulted in those formal actions were held, in meetings open to the public in compliance with the law. SECTION 3: That this Resolution is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety and welfare and for the further reason that it will more expeditiously realize, secure and receive needed funds for the Sewer Revenue Fund; and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
