CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2020 - 94 <br />BY: Mayor Kennedy <br />AN ORDINANCE (1) DECLARING THE STR UCTURALL Y <br />COMPROMISED MACKENZIE ROAD CULVERT TO BE A PUBLIC <br />EMERGENCY, (2) APPROPRIATING FUNDS FOR EMERGENCY <br />REPLACEMENT OF THE CULVERT, (3) AUTHORIZING THE CITY <br />ENGINEER TO SOLICIT BIDS FROM SELECT OHIO DEPARTMENT OF <br />TRANSPORTATION PRE -QUALIFIED CONTRACTORS FOR THE <br />AWARD OF A CONTRACT TO PROVIDE EMERGENCY CONSTRUCTION <br />SERVICES PURSUANT TO THE EMERGENCY EXCEPTION TO PUBLIC <br />BIDDING AS DETAILED IN THE SPECIFICATIONS ON FILE IN THE <br />DIVISION OF ENGINEERING AND; (4) AUTHORIZING THE MAYOR TO <br />CONTRACT FOR SAID REPAIRS, FOLLOWING APPROVAL BY THE <br />BOARD OF CONTROL, AND DECLARING AN EMERGENCY. <br />WHEREAS, due to the need for maintenance, the Mackenzie Road culvert was scheduled <br />for slip lining repair in the year 2020 through the State Cooperative Purchase Program; and <br />WHEREAS, in furtherance of the 2020 project, the Ohio Department of Transportation <br />("ODOT") re -inspected the culvert in late June and found significant voids in the culvert pipe, <br />thereby downgrading the rating and recommending a full replacement in lieu of slip lining; and <br />WHEREAS, by the end of July, further inspections made clear that a temporary repair <br />pending bidding and contract award would not suffice, as the culvert pipe is too badly corroded and <br />ongoing efforts to stabilize the culvert and, necessarily, the roadway, have resulted in those <br />materials washing away; and <br />WHEREAS, given the urgency of the situation due to the rapidly deteriorating culvert, <br />design engineering for a complete replacement was declared the highest priority and has been <br />completed by Engineer Pete DiFranco; and <br />WHEREAS, the cost of construction estimate is $360,000.00; and <br />WHEREAS, in a cooperation agreement, the State of Ohio has proposed that the City of <br />North Olmsted cover the cost of design and construction engineering and ODOT will cover the cost <br />of the construction contract. The City of North Olmsted will pay for the construction contract and <br />will be reimbursed by ODOT; and <br />WHEREAS, North Olmsted Charter Art. VIII, Finances, §6, Public Bidding, provides as <br />follows: <br />The Council may authorize expenditure of funds of the City in amounts exceeding <br />those provided for from time to time by the general laws of the State of Ohio <br />governing municipal corporations without public bidding... during real and present <br />emergencies in order to immediately provide for the health, safety and welfare of <br />the residents of North Olmsted....; and <br />
