WHEREAS, upon the recommendation of the Mayor and the Engineer, this Council desires to declare the structurally failing Mackenzie Road culvert to be a public emergency and to authorize the City Engineer and Mayor to proceed with emergency repairs pursuant to Charter Art. VIII, §6. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: SECTION 1: The structurally failing culvert on Mackenzie Road is hereby declared to be a public emergency, necessitating immediate repairs without formal public bidding pursuant to Charter Art. VIII, §6 in order to preserve the public health safety and welfare of the residents of the City of North Olmsted. SECTION 2: That to provide for the expense and to authorize the expenditure, the sum of $370,000.00 be and is hereby set aside and appropriated from the 295 Permanent Improvement Street and Storm Fund, with $10,000 being added as a contingency to the construction estimate. SECTION 3: The City Engineer is authorized to solicit bids from select ODOT pre- qualified contractors pursuant to specifications on file in the Division of Engineering. SECTION 4: The Mayor be, and he hereby is, authorized to enter into a contract to replace the Mackenzie Road culvert with the contractor selected from the pre -qualified contractor list, following approval by the Board of Control, and is further authorized to execute all agreements required by the State of Ohio to undertake said project. SECTION 5: That this Ordinance is hereby declared to be an emergency measure immediately necessary for the preservation of the public health, safety, and welfare, and for the further reason that this condition endangers the motoring public and will increase in cost and inconvenience over time if not addressed immediately; and further provided that it receives the affirmative vote of two-thirds of all members of Council, it shall take effect and be in force immediately upon its passage and approval by the Mayor.
