WHEREAS, upon the recommendation of the Mayor and the Engineer, this Council desires <br />to declare the structurally failing Mackenzie Road culvert to be a public emergency and to authorize <br />the City Engineer and Mayor to proceed with emergency repairs pursuant to Charter Art. VIII, §6. <br />NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, COUNTY OF CUYAHOGA AND STATE OF OHIO: <br />SECTION 1: The structurally failing culvert on Mackenzie Road is hereby declared to be a <br />public emergency, necessitating immediate repairs without formal public bidding pursuant to <br />Charter Art. VIII, §6 in order to preserve the public health safety and welfare of the residents of the <br />City of North Olmsted. <br />SECTION 2: That to provide for the expense and to authorize the expenditure, the sum of <br />$370,000.00 be and is hereby set aside and appropriated from the 295 Permanent Improvement <br />Street and Storm Fund, with $10,000 being added as a contingency to the construction estimate. <br />SECTION 3: The City Engineer is authorized to solicit bids from select ODOT pre- <br />qualified contractors pursuant to specifications on file in the Division of Engineering. <br />SECTION 4: The Mayor be, and he hereby is, authorized to enter into a contract to replace <br />the Mackenzie Road culvert with the contractor selected from the pre -qualified contractor list, <br />following approval by the Board of Control, and is further authorized to execute all agreements <br />required by the State of Ohio to undertake said project. <br />SECTION 5: That this Ordinance is hereby declared to be an emergency measure <br />immediately necessary for the preservation of the public health, safety, and welfare, and for the <br />further reason that this condition endangers the motoring public and will increase in cost and <br />inconvenience over time if not addressed immediately; and further provided that it receives the <br />affirmative vote of two-thirds of all members of Council, it shall take effect and be in force <br />immediately upon its passage and approval by the Mayor. <br />PASSED: Al�;y�4 First Reading.- <br />Second <br />eading.Second Reading.- <br />Third <br />eading.Third Reading.- <br />Committee: <br />eading.Committee: <br />ATTEST: <br />CHARLES MASS ROLO II <br />Clerk of Council <br />APPROVED: le'l - _?,Cf9 <br />2 <br />NICOLE DAILEYJONE, <br />President of Council <br />APPROVED AS TO LEGAL FORM.- <br />2 <br />ORM: <br />
