Use of Injury IIIvestigation Committee may bewaived by <br />mutual agreement of the Association and the Fire Chief on a case by case basis. <br />17.1(c) If after ninety (90) days either an IIIness or injury still temporarily incapacitates <br />the employee. the Safety Director shall recommend to Council whether to continue salary. <br />t, nunc"I shall forthwith review the matter and by° a mnjor"ty vote determine whether the <br />employee shall continue to recei�-e full salary dor"ng recuperation. <br />17.2 Any full-time employee of the Fire Department \\ ho qualifies for benefits under this <br />Section shall be required to pay over to the City any amount received from the Bureau of <br />Workers` Compensation as supplemental gages. Further. "fat any time the City determines, on <br />the basis ofinedical evidence, that the employee is permanently disabled and will no longer be <br />able to carry on his duties, then the City may terminate payments and insist that the employee go <br />on a pension program. <br />17.3 Any employee who qualifies for the beliCf ItS under this Section shall riot have his <br />accumulated sick time reduced because of qualified accidental injury or illness which occurred <br />while in the line of duty. <br />17.4 In the event an employee has been injured or exposed to a toxic substance or to an <br />infectious disease in the course or scope of` his employment, and is sent to the hospital for <br />testing, treatment, and/or preventive measures. and Worker's Compensation subsequently <br />determines that there Akas no Injury sustained. shall have all bills pertaining to the eployces <br />m <br />testing, treatment. and/or preventive measulres be the responsibility of the Employer. <br />17.5 Any employee o'f the Employer vNho has not qualified for any of the benefits of this <br />article but has sustained an illness/injury in the scope of Ills employment and used his ovvlt sick <br />leave may opt to turn over to the E ITiployer any amount received from the Bureau of` Worker's <br />Compensation.
