Exhibit A: Chapter 1163 Signs (Current) <br />explanation of the delay and balance them against the hardship to the applicant arising from <br />an extended time for determination. <br />C. Failure of the Building Commissioner to issue a permit within the required ten (10) business <br />days or, if an extension has been obtained, within the time permitted by the extension, shall <br />be construed to be an issuance of the permit, upon the lapse of the last day upon which the <br />Building Commissioner may, pursuant to paragraph (B) above, make his determination. <br />D. If the proposed sign or advertising structure complies with this and all other applicable laws <br />and ordinances of the City, the Building Commissioner shall forthwith issue the requested <br />permit upon receipt of the appropriate fees. If the Building Commissioner determines that <br />the application should be denied, he shall issue a written statement contemporaneous with <br />his decision, explaining the reason or reasons for the denial. <br />E. If an application for an erection permit is part of a lot development or redevelopment <br />proposal made pursuant to Chapter 1126 of this Zoning Code, then the permit issued by the <br />Building Commissioner shall be a temporary permit only pending final approval by the City <br />of the lot development or redevelopment proposal pursuant to the provisions of said Chapter <br />1126. Said temporary permit shall become permanent only upon the applicant erecting the <br />applied for sign or signs, or modifying already erected sign or signs, in a manner which <br />meets all structural and locational requirements made a condition of the City's final approval <br />of the lot development or redevelopment proposal. Every applicant who obtains a temporary <br />erection permit pursuant to the provisions of this paragraph of this section shall be required <br />to post a bond with the Building Commissioner equal to the cost of the sign to be erected, <br />before erecting said sign pursuant to the temporary permit. Said bond shall be forfeited to <br />the City if the applicant, upon receiving final approval for a lot development or <br />redevelopment approval, erects a sign or signs, or fails to modify a sign or signs, in violation <br />of an express condition or conditions of that final approval. <br />F. If the work authorized under any erection permit is not completed within six (6) months after <br />the date of issuance, said permit shall become null and void. <br />(Ord. 2008-6. Passed 4-1-08.) <br />Section 1163.07 Permit Fee <br />Every applicant, upon applying for a permit pursuant to Section 1163.06, shall pay to the <br />Building Commissioner the nonrefundable fee established by separate ordinance. Applications <br />for temporary sign permits shall not require a fee. <br />(Ord. 2008-6. Passed 4-1-08.) <br />Section 1163.08 Appeal <br />If the applicant is dissatisfied with any determination of the Building Commissioner made during <br />the course of the application process, including but not limited to the calculation of the fee due, <br />the requirement of additional materials, the classification of a proposed sign, the denial of a <br />permit, or the revocation of a permit, the applicant may, within ten business (10) days following <br />that determination, file with the Building Commissioner an appeal from the Commissioner's <br />decision to the Building and Zoning Board of Appeals. Upon receiving such a notice of appeal, <br />the Building Commissioner shall transmit all papers and other documents connected to the <br />application to the Building and Zoning Board of Appeals, which shall hear the applicant's appeal <br />at a meeting which shall be scheduled and held no later than 30 days following the date of the <br />filing of the notice of appeal.
