CITY OF NORTH OLMSTED ORDINANCE NO. 2020 - 117 BY: Mayor Kennedy AN ORDINANCE AMENDING SECTION 555.09 "EMERGENCY EXCEPTION" OF CHAPTER 555 "NOISE CONTROL " OF THE GENERAL OFFENSES CODE OF THE CODIFIED ORDINANCES OF THE CITY OF NORTH OLMSTED TO INCLUDE EMERGENCY GENERATORS AS AN EXCEPTION TO NOISE CONTROL STANDARDS, AND DECLARING AN EMERGENCY. WHEREAS, portable and stationary generators for home use to create substitute power during interruption of regular utility electric service in an emergency situation are becoming more prevalent in the City of North Olmsted; and WHEREAS, stationary generators have long been used in commercial districts of the City; and WHEREAS, generators are not exempted from the noise standards set forth in Chapter 555, "Noise Control;" and WHEREAS, the City of North Olmsted Administration desires to permit the use of generators in emergency situations, subject to reasonable regulations; and WHEREAS, it is the desire of this Council to amend Section 555.09 "Emergency Exception" of Chapter 555 "Noise Control" to permit the use of generators in emergency situations and to establish reasonable noise standards. NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: SECTION 1: That Section 555.09, which currently reads as follows: 555.09 EMERGENCY EXCEPTION. The provisions of this chapter shall not apply to the emission of sound for the purpose of alerting persons to the existence of an emergency, or the emission of sound in the performance of emergency work. SHALL BE AMENDED AND AS AMENDED SHALL READ AS FOLLOWS: 555.09 EMERGENCY EXCEPTION.
