CITY OF NORTH OLMSTED <br />ORDINANCE NO. 2020 - 117 <br />BY: Mayor Kennedy <br />AN ORDINANCE AMENDING SECTION 555.09 "EMERGENCY <br />EXCEPTION" OF CHAPTER 555 "NOISE CONTROL " OF THE GENERAL <br />OFFENSES CODE OF THE CODIFIED ORDINANCES OF THE CITY OF <br />NORTH OLMSTED TO INCLUDE EMERGENCY GENERATORS AS AN <br />EXCEPTION TO NOISE CONTROL STANDARDS, AND DECLARING AN <br />EMERGENCY. <br />WHEREAS, portable and stationary generators for home use to create substitute power <br />during interruption of regular utility electric service in an emergency situation are becoming <br />more prevalent in the City of North Olmsted; and <br />WHEREAS, stationary generators have long been used in commercial districts of the <br />City; and <br />WHEREAS, generators are not exempted from the noise standards set forth in Chapter <br />555, "Noise Control;" and <br />WHEREAS, the City of North Olmsted Administration desires to permit the use of <br />generators in emergency situations, subject to reasonable regulations; and <br />WHEREAS, it is the desire of this Council to amend Section 555.09 "Emergency <br />Exception" of Chapter 555 "Noise Control" to permit the use of generators in emergency <br />situations and to establish reasonable noise standards. <br />NOW THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF <br />NORTH OLMSTED, CUYAHOGA COUNTY, AND STATE OF OHIO: <br />SECTION 1: That Section 555.09, which currently reads as follows: <br />555.09 EMERGENCY EXCEPTION. <br />The provisions of this chapter shall not apply to the emission of sound for the purpose of <br />alerting persons to the existence of an emergency, or the emission of sound in the performance of <br />emergency work. <br />SHALL BE AMENDED AND AS AMENDED SHALL READ AS FOLLOWS: <br />555.09 EMERGENCY EXCEPTION. <br />The provisions of this chapter shall not apply to the emission of sound for the purpose of <br />alerting persons to the existence of an emergency, or the emission of sound in the performance of <br />emergency work. <br />
