lower rate classification within the bargaining unit, provided the employee has the ability to do <br />the work of the classification. <br />12.03 Whenever practicable, regular full-time employees shall be given a minimum of two (2) <br />weeks advance notice of layoff. <br />12.04 In the event an employee is laid off. he/she shall receive payment for any earned but <br />unused vacation as quickly as practicable, but no later than fourteen (14) calendar days after the <br />lav -off. <br />ARTICLE 13 RECALL: FROM LAY-OFF <br />13.01 Employees shall be recalled to their classification in accordance with seniority, or to <br />other jobs they are qualified to perform, in accordance ,N ith their seniority in the reverse order of <br />their lay-off. An employee on lay-off will be given fourteen (14) calendar days' notice o#'recall <br />from the date on which the I.Jnited States Postal Service makes the first attempt to deliver the <br />recall notice by certified mail to the employee's last known address as shown on the Employer's <br />records. An employee shall maintain recall rights for twenty-four (24) months from date of <br />layoff. This period may be extended by agreement between the Employer and the Union. <br />ARTICLE 14 PROMOTIONS, BIDDING, TRANSFERS <br />AND JOB TRAINING <br />14.01 Within ten (10) days of'when a vacancy occurs within a job classification covered by the <br />terms of this Agreement, that the Employer intends to rill, or a new job is created within the <br />meaning of Article 18 of this .Agreement, the Employer shall post a notice of the opening for <br />seven (7) consecutive calendar days on bulletin boards within each department. If the Employer <br />determines that it will not fill a vacant position it Nvill so notify the Union. The notice shall <br />contain the job classification, title, rate of pay, department and a brief job description. Any <br />employee may apply for any such opening posted by tiling a written application on forms <br />provided by the Employer, with the appropriate Director on or before the last day of the posting <br />period. Any application not timely filed need not be given consideration. <br />Whenever the Employer anticipates that a position within a classification that is covered <br />by this collective bargaining agreement is currently occupied will become open within thirty (30) <br />working days as a result of a retirement, termination, resignation or as a result of another job <br />posting and the Employer determines that the position will be retained or tilled, it may be <br />permitted to post the position and classification for a period of'seven (7) consecutive working <br />days and award the position. <br />14.02 All timely applications will be reviewed by the Employer and the job shall be awarded <br />within five (5) working days to the applicant who possess the most skill, experience, ability and <br />seniority to perform the job, except those employees moving to a lower rated classification or <br />moving laterally shall be awarded the job in preference to employees seeking a promotion. If no <br />employee who applies has the necessary skill or ability, the Employer shall have the authority to <br />hire outside the bargaining unit.
