SECTION 3: If an employee is required to submit a x\ritten report. they shall be advised of the <br />reason for such report. <br />SECTION 4: In the event that disciplinary action is taken against a member. the memher shall <br />have the right to request the presence of an OPBA represcrntatiye when Such action is taken. <br />SECTION S: Ifall screenim-, and conlirmatory tests are positive regarding the use of non - <br />felonious drugs. the City shall require the ernploycc to participate in a rehabilitation or <br />detoxification program as determined by appropriate medical personnel. This provision shall <br />apply to only the first incident of positive testing of or the use cif non -felonious drugs. Any <br />employee testing positive for the use of non -felonious drugs the second time any employee <br />testing positive for and/or the use of felonious (11-1.11's may be subject to disciplinary action up to <br />termination at the Empliwer's discretion without any rehabilitation pro,ram. <br />SECTION 6: An employee who participates in a rehabilitation or detoxification program shall <br />be allowed to use sick leayc. vacation leave. or personal days for the period ol'the rehabilitation. <br />If no such leave credit is available: such employee may be placed on an unpaid medical leave of <br />absence. <br />SECTION 7: Upon completion ol'the program and retest that demonstrates that the employee is <br />no longer illegally using a controlled substance, the employee shall be returned to their position. <br />Such employee may be subject to periodic retesting at the Employer"s discretion upon return to <br />their position for a period of two (2) years from the date of their return. <br />SECTION 8: Any employee in the above mentioned rehabilitation program vyill not lose anti <br />seniority should it be necessary that they be required to take an unpaid medical lease of absence. <br />ARTICLE 27: <br />SCHOOLING <br />SECTION I : Full-time employees in attendance at an Employer approved training school shall <br />be compensated at the appropriate rate for travel time from the F.mployers premises to the <br />location ofthe training school and all time spent in the class session unless total hours in the <br />L)iven week are over forty (40). The employee attending such approved training school out of tile. <br />Employer. shall be reimbursed for lunch in an amount not to exceed $7.00 per day by the <br />Employer. upon presentation of a receipt for such lunch. The employee attending such training <br />school shall be paid mileage expense for the use of his personal vehicle in accordance with the <br />IRS approved rate or he may be provided a vehicle owned by the Employer. <br />SECTION 2: Whenever an employee requires training in dispatch. the designated training <br />dispatcher will receive an additional IMir hundred dollars ($400.00) per year. A minimum of <br />two (2) employees will be designated as training dispatchers.
