Council Minutes of 12-01-2020 <br />Director Gareau said he also said if Mr. Glassburn wants to proceed in requesting a road <br />study for road improvements in the City he should do that as well, but it should be done <br />in a separate piece of legislation. Director Gareau said Mr. Glassburn knew there were <br />people that were opposed to certain aspects of the Clague Road project because he <br />believed Mr. Limpert was one of them. However, he said Mr. Glassburn went ahead and <br />married this to a different subject that has nothing to do with the scope of the original <br />ordinance requested and that was the basis of the opinion offered to Council. Director <br />Gareau said he got Mr. Glassburn's memo in response to his opinion earlier this <br />afternoon. He said he had already looked into the 2017 issue before and the 2017 legal <br />advice offered on the floor of City Council was quite clear. He said he advised Council <br />because it was a comprehensive zoning ordinance restructuring, which was the result of <br />the comprehensive master plan, it was a complete rewrite of the business code and <br />business zoning districts of the City and were put in a single piece of legislation. <br />Someone asked if it was log rolling and Director Gareau said it was not. Director Gareau <br />said the opinion stated there was some unity between the subjects and in fact it would be <br />fine. Director Gareau said that was the opinion he gave. Director Gareau said he thought <br />Mr. Glassburn was out of line to suggest he gave false legal advice. He said if Mr. <br />Glassburn wished to have some legal advice he should ask for it, but to come to a <br />meeting without ever contacting him, which seems to be a pattern now... <br />Council President Jones took back the floor by thanking the Director of Law for his <br />comments. <br />Councilwoman Hemann Chairwoman of the Environmental Control Committee: <br />The Environmental Control Committee met on Tuesday, November 24, 2020 at 7:25 p.m. <br />Present were committee members Hemann, Glassburn and Williamson; Council members <br />Brossard, Kelly, Limpert and Schumann; Council President Jones; Mayor Kennedy, <br />Director of Finance Copfer, Director of Human Resources Gallo, Director of Law Gareau <br />and guests. <br />• Discussed was Resolution 2020-126. A Resolution authorizing the Mayor to <br />purchase a new 375 KVA Generator from Ohio CAT at a cost of $61,300.00 for <br />the Lebern Pump Station, through a State Purchase Program; and further <br />authorizing the Mayor to execute all contract documents for purchase of the same. <br />Chairperson Hemann said she had talked with the Superintendent of the Waste <br />Water Treatment Plant to obtain the background information on the pump station, <br />which was last redone in 2012. The subject generator was not replaced at that <br />time as it had not expanded its useful life. It is housed in a metal shed type <br />structure, which is also old and noisy. The proposed replacement is slightly larger, <br />quieter and will increase the overall function ability by increasing the volume of <br />water pumped out of the system after retention in the EQ basin. The purchase of <br />this generator will assist in reducing basement flooding. This purchase is part of <br />the five year plan for the Waste Water Treatment Plant and was intended to be <br />introduced in the 2021 budget. It is being brought forth now because there was a <br />surplus in the 2020 budget due to other projects being done under budget or not <br />needed as originally planned. The Director of Finance confirmed the availability <br />of funds and no money is being used from other sources which would reduce <br />5 <br />
