EXHIBIT <br />-A Temporary Indoor Dining <br />During this time of COVID-19 restrictions, restaurants (hereinafter "Permanent Licensed Business") in the City <br />of North Olmsted (the "City"), whose indoor seating capacity has been impacted by the current State of Ohio <br />COVID-19 gathering restrictions are permitted to utilize temporary additional indoor dining, to obtain increased <br />capacity subject to existing City, State of Ohio and County Board of Health codes. <br />In order to assist Licensed Food Businesses during this time of challenge, the following information is offered <br />for guidance. <br />Time limited occupancy, or temporary space for indoor dining, is available for potential use in currently vacant <br />commercial retail space located within an approximate distance of 250 feet from a currently Licensed Food <br />Business, without crossing a road, and must exist within the same retail plaza area. <br />Each Licensed Food Business seeking to utilize a temporary space for indoor dining is encouraged to work with <br />the landlord for the use of the temporary space arrangement. The Licensed Food Business will be responsible <br />for adherence to the Board of Health and State of Ohio regulations for operation of its temporary space for <br />indoor dining in the same manner that it is currently obligated to do for the main, original restaurant location of <br />the Licensed Business. <br />The authorized use of temporary space for indoor dining shall expire at the time set forth in the certificate of <br />occupancy issued by the City for the time limited occupancy. <br />Conditions: <br />Pursuant to requirements of the City of North Olmsted: <br />Each Licensed Food Business must provide written approval from the property owner of the vacant space for <br />the use of the proposed temporary space. <br />To obtain limited time occupancy, the Permanent Licensed Business must: <br />Apply at the Building Department of the City using the "Plan Approval and General Building Permit - <br />Commercial" application form available on line. The application shall indicate that the applicant is <br />applying for a "time limited occupancy" for dining purposes accessory to their existing occupancy in the <br />scope section of the application. The Applicant shall also provide an accurate scaled floor plan of the <br />existing space with the application and also provide a copy to the Board of Health. The City shall <br />provide applicant, without charge, a copy of any floor plans on file for the space that is the subject of the <br />proposed time limited occupancy. With a completed application and fee, the application for proposed <br />time limited occupancy (temporary space for indoor dining) shall be reviewed for compliance with <br />applicable Ohio Building Code requirements. <br />• The applicant will take notice that, among other regulations, occupants in the temporary space pursuant <br />to a certificate of occupancy issued for a limited time occupancy, pursuant to the Ohio Building Code, <br />shall not exceed fifty (50) persons. This is a maximum number under the Ohio Building Code and may <br />be significantly less due to Covid-19 restrictions. Proposals greater than fifty (50) person occupancy <br />may require a separate review process. <br />• Restroom facilities in the temporary space are not required, based on the nature of the temporary permit. <br />Patrons shall utilize the restroom facilities at the Originally Licensed Food Business.
