MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF NORTH OLMSTED JANUARY 19, 2020 Present: Council President Jones, Council Members Brossard, Glassburn, Hemann, Kelly, Limpert Schumann & Williamson Also Present: Mayor Kennedy, Director of Finance Copfer, Director of Human Resources Gallo, Director of Law Gareau, Director of Planning & Community Development Lieber and Clerk of Council Massarolo Council President Jones called the meeting to order at 8:00 p.m. through GoToMeeting. Due to the meeting being a virtual meeting, Council President Jones requested if any member of the public using a computer wished to address Council to notify the Clerk via the chat feature in GoToMeeting and they would be called on later in the meeting. For those dialing in via phone, the lines would be unmuted during the appropriate portion of the meeting. The Council Meeting Minutes of December 15, 2020 were approved as written. The Special Council Meeting Minutes of December 22, 2020 were approved as written. The following legislation will be considered for passage under suspension of the rules this evening: Second Reading: Resolution 2020-158, Resolution 2021-1; First Reading: Resolution 2021-8, Resolution 2021-9 and Resolution 2021-11. REPORTS Mayor Kennedy: • No Report. Director of Law Gareau: • State Ex. Rel. v. Cuyahoga County Prosecutor's Office and the City of North Olmsted is a case which has been reported out on several occasions. It was dismissed twice. The Court of Appeals dismissal was affirmed and now it is heading the Ohio Supreme Court. Director Gareau said he would be representing the City before the Supreme Court. The case is several weeks away from briefing and he anticipates an oral argument at some point in Columbus. • Another matter is Kelly Patrick v. City of North Olmsted, in the Court of Claims. This is a new area where they allowed for public records cases to be commenced in the Court of Claims with the idea it can be cleared out and moved along more expeditiously. This matter is set for mediation on January 22 at 10 a.m. The Department of Law is working to resolve this particular issue. • On January 27, the Mayor, Director Copfer, and others will make a presentation before Moody's to deal with our bond rating. It's been done a couple other times and we will be ready to go.
