MINUTES OF THE MEETING OF THE COUNCIL <br />OF THE CITY OF NORTH OLMSTED <br />FEBRUARY 16, 2021 <br />Present: Council President Jones, Council Members Brossard, Glassburn, Hemann, <br />Kelly, Limpert Schumann & Williamson <br />Also Present: Mayor Kennedy, Director of Finance Copfer, Director of Human <br />Resources Gallo, Director of Law Gareau, Director of Planning & <br />Community Development Lieber and Clerk of Council Massarolo <br />Council President Jones called the meeting to order at 8:00 p.m. through GoToMeeting. <br />Due to the meeting being a virtual meeting, Council President Jones requested if any <br />member of the public using a computer wished to address Council to notify the Clerk via <br />the chat feature in GoToMeeting and they would be called on later in the meeting. For <br />those dialing in via phone, the lines would be unmuted during the appropriate portion of <br />the meeting. <br />The Council Meeting Minutes of February 2, 2021 were approved as written. <br />The following legislation will be considered for passage under suspension of the rules <br />this evening: Second Reading: Resolution 2021-14; First Reading: Resolution 2021-18. <br />REPORTS <br />Mayor Kennedy: <br />• No Report. <br />Director of Law Gareau: <br />• North Olmsted filed its brief today in the pending action in the Ohio Supreme <br />Court dealing with a statutory right of action for our resident to demand <br />prosecution. The City is hoping it has a fairly strong case and that it will be <br />resolved in our favor. <br />• The City has initiated litigation for the nonpayment of hotel motel tax against <br />Shree Shankar, LLC, that's Paul Patel doing business as La Quinta. It has been <br />unsuccessful in service so far, but the City would like the judgement against him <br />to collect the fees that North Olmsted uses to purchase equipment for police and <br />fire safety forces. These are taxes that he charged guests who have stayed there. <br />He then never paid those tax funds to the City. While times are tough and the <br />hotel/motel industry has taken a hit, he is only going to pay what he actually <br />charged who stayed there. <br />• There is an appeal in McColgan v. City of North Olmsted. This is a worker's <br />comp claim that has been appealed. The applicant was not satisfied with the result <br />he received through the Worker's Compensation process and has now taken his <br />appeal to Court. The City is working it out. <br />• The city is pursuing a nuisance house on Fitch Road. It has been abandoned and <br />the owner has passed away. There have been numerous maintenance reports <br />
